PLAINTIFFS' MOTION TO COMPEL ATTENDANCE AND MOTION TO IMPOSE
SANCTIONS PURSUANT TO Pa. R.C.P.. RULES 234.5(b) and 4019(c)
TO THE HONORABLE JUDGES OF SAID COURT:
AND NOW, November 27, 2006, come the Plaintiffs James J. Touloumes, Jr. and Froso
Touloumes, by and through their attorneys GeisenbergerCooper & Lanza, P.C., and file this
Motion To Compel Attendance and Motion to Impose Sanctions on Defendants for reasonable
costs incurred, pursuant to Pa. R.C.P. 234.5(b), 4019(c), and C.C.R.P. 208.3(a) in the above-
captioned matter for the reasons hereinafter set forth:
1. Defendants in this matter are Thomas Scott Pedersen and Donna K. Pedersen, pro
se. Defendants' last known home address is 9 Todd Road, Carlisle, Cumberland
County, Pennsylvania 17013.
2. On October 31, 2005, judgment was entered for Plaintiffs against Defendants in
the amount of$3110.70 by Magisterial District Judge Paula P. Correal.
3. On August 22,2006, Plaintiff entered the judgment against Defendants in
Common Pleas Court.
4. On or about October 11, 2006, Plaintiffs served a Notice of Taking Discovery in
Aid of Execution on Defendants at Thomas Scott Pedersen's business address,
with said deposition scheduled for November 13, 2006. (Attached here as Exhibit
#1.)
5. Defendants never responded to said Notice, and failed to Appear at the deposition
as scheduled.
6. Defendants have not paid the judgment.

WHEREFORE, Plaintiffs respectfully request that this Honorable Court Compel
Attendance of Defendants at the next scheduled deposition to be held on
, 2006, and order Defendants to testify and bring documents as
outlined in attached Exhibit # 1, under penalty of contempt, and;
Plaintiffs respectfully request that this Honorable Court, by way of sanctions, impose on
Defendants the costs of reasonable expenses actually incurred by Plaintiff s counsel,
including but not limited to the hiring of Court Reporters for the November 13, 2006,
deposition, transportation expenses for traveling to and from Harrisburg, P A, and
reasonable attorney fees in the amount of five hundred ($500) dollars.

hereby given that the individual and separate depositions of Thomas Scott Pedersen and Donna
K Pedersen will be taken upon oral examination at Pennsylvania Bar Association, NCR Room,
100 South Street, Harrisburg, Pennsylvania 17101, on November 13,2006, at 10:00 o'clock a.m.
and at any and all adjournments thereof.
You are to testify concerning your assets.
You are ordered to bring with you the originals of all tax returns for the year 2005 and
the previous three (3) years, checking and savings bank account statements for the last six (6)
months, deeds to any properties owned be either of you individually, by both of you, or jointly
with any other person, and any other financial information relevant to the discovery of your
assets including automobile titles, stock certificates, certificates of deposit, bonds, etc.
If you fail to attend or to produce the documents or things required by this Notice to
Attend, you may be subject to the sanctions authorized by Rule 234.5 of the PeIlllsylvania Rules
of Civil Procedure.

ORDER OF COURT
AND NOW, this 25th day of January, 2007, this being the time and place for a
hearing on the Plaintiffs' Motion to Compel Attendance and Motion to Impose Sanctions,
and the Court noting that the Counsel for Plaintiffs has appeared and is ready to
proceed, and that the Defendants, Thomas Scott Pedersen and Donna K. Pedersen,
have failed to appear in violation of this Court's Order of December 11, 2006, and have
failed to file an answer to Plaintiff's Notice of Taking Discovery in Aid of Execution.
Accordingly, IT IS HEREBY ORDERED AND DIRECTED that the Rule to Show
Cause shall be made Absolute and a Bench Warrant shall issue for the Arrest of the
Defendants, Thomas Scott Pedersen and Donna K. Pedersen. It is specifically ordered
that the Sheriff of Cumberland County shall only serve this warrant on a weekday
between the hours of 8:30 a.m. and 3:00 p.m. and shall bring Thomas Scott Pedersen
and Donna K. Pedersen immediately before the Court for the purposes of posting
security and setting a final hearing on the issue of Sanctions. This Order of Court shall
suffice as the Bench Warrant.
