STIPULATION AGAINST LIENS

THIS AGREEMENT made the /..L.day of August, 2006 by and between REESE BUILDERS
Contractor,
AND
CHARLES W. HICKS and SUZANNE K. HICKS, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate
in
Lot # 29 Nicholas Drive, Carlisle, DICKINSON TOWNSHIP, Cumberland, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ($1.00) Dollar to < - Contractor> in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection
and construction of the said buildings on the lot above described, and the said Contractor, for themselves,
their subcontractors and others under them hereby expressly waive and relinquish the right to have, file,
and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County, Pennsylvania,
known as Lot 29 and more fully described on the Final Subdivision Plan for Phase 1 of Nicholas Manor,
prepared by Statler-Brehm Associates, Inc., dated October 13,1999 and recorded April 17, 2000 in the
Office of the Recorder of Deeds in and for Cumberland County, in Plan Book 80, Page 135, bounded and
described as follows, to wit:
BEGINNING at a point along the northern right of way line of Nicholas Drive at the dividing line between
Lot No. 28 and Lot No. 29 of the aforementioned plan; thence along said dividing line between said Lot No.
28 and Lot No. 29, North 79 degrees 32 minutes 51 seconds East 133.57 feet to a point; thence continuing
along the same, North 24 degrees 05 minutes 19 seconds East 222.95 feet to a point; thence along the
dividing line between Lot No. 29 and Lot No. 30, South 62 degrees 23 minutes 20 seconds East 175.00
feet to a point; thence continuing along the same, South 24 degrees 05 minutes 12 seconds West 122.17
feet to a point; thence along the dividing line between Lot No. 29 and Lot No. 31, South 24 degrees 05
minutes 12 seconds West 147.83 feet to a point; thence continuing along the same, South 79 degrees 32
minutes 51 seconds West 215.91 feet to a point along the right-of-way line of Nicholas Drive; thence along
said right-of-way line of Nicholas Drive by a curve to the left having a radius of 225.00 feet, a chord bearing
of North 18 degrees 00 minutes 30 seconds West, and an arc length of 14.77 feet to a point; thence
continuing along said right-of-way line of Nicholas Drive, North 19 degrees 53 minutes 20 seconds West
88.25 feet to a point; thence continuing along said right-of-way line of Nicholas Drive by a curve to the left
having a radius of 225.00 feet, a chord bearing of North 25 degrees 50 minutes 12 seconds West, and an
arc length of 46.72 feet to a point, the place of BEGINNING.
CONTAINING a gross lot area of 68,359 square feet.
UNDER AND SUBJECT to covenants, conditions, reservations, restrictions, easements and right of ways
of record.
BEING THE SAME PREMISES which Donald E. Diehl and Suzanne Diehl, and Rene L. Diehl, Trustees for
Carlin Elizabeth Diehl and Evan Christopher Diehl, by deed to be recorded simultaneously herewith in the
Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Charles W. Hickes
and Suzanne K. Hickes.
