Szeles, Inc., by its attorneys, Goldberg Katzman, P.C., and files the within Mechanic's Lien claim against the building hereafter described and the curtilage thereto for the payment of a debt due to Claimant as contractor in the fire and water damage restoration of said building and makes the following statement of demand: 1. Claimant is Alex R. Szeles, Inc., a fire restoration specialist, buildcr/home improyement company with a bnsiness address at 945 East Park Drive, Suite 101, Harrisburg, PA 17111. 2. The "Owners" are John W. Lane and/or Mountain Creek Properties, L.P. Mr. Lane is the managing partner of Mountain Creek Properties, L.P. and has a business address of 3 South 40th Street, Camp Hill, PA l70l1. 3. Owners currently own the buildings and curtilage currently existing at 600 North Baltimore Ayenue, Mount Holly Springs, Cumberland County, PA, 17065 (the "Property"). 4. On or about March 18, 2005, the building at the Property, suffered fire damage which necessitated extensive emergency restoration work. 5. On or about March 21, 2005, Owners contracted with Claimant to perform the emergency restoration work to the buildings at the Property. 6. Claimant immediately commenced the restoration work on or about March 21, 2005. The work consisted of extensiye restoration work, as is described in the Bill of Particulars attached hereto as Exhibit A, which is incorporated by reference. 7. Without limiting the full extent of the restoration work described on Exhibit A, the work consisted of extensiye restoration, including cleaning, repair and replacement of property and fixtures, as well as structural work, to the entirety of the property, including living areas, kitchens, closets, entry ways, stairways, main halls, bathrooms, patios, back rooms, landings and bedrooms. 8. During the course of Claimant's fire restoration work, described aboye, a water pipe at the property ruptured causing additional water-related damage at the Property. 9. Claimant performed restoration services to clean up the water damage at the Property, as well. 10. The water-related restoration work performed by Claimant is fully described on the Bill of Particulars attached hereto as Exhibit B, and which is incorporated by reference herein. 11. Without limiting the full extent of the repairs, which are described on Exhibit B, Claimants services and materials at the Property included water extraction, application of anti- ....ODMAIPCDOC!MXJCS\138498\1 2 microbial agents, drying and replacement of floors and carpeting in yarious rooms of the Property. 12. Claimant completed its fire and water restoration work on May 3, 2006. Said work was performed in a reasonable and workmanlike manner, thns entitling Claimant to payment therefore. 13. To date, Owners haye failed to pay Claimant the full amount which is due for the work completed upon the premises. The parties had agreed to a figure of$577,323.02 for all work performed with regard to the fire restoration by Claimant, per letter dated December 6, 2005, which is attached hereto as Exhibit C. 14. The parties had agreed to an amount of $8,779.56 for the water-damage related repairs and restoration, yielding a total amount due Claimant of$586,102.58. 15. To date, Claimant has billed Owners for that amount, for all work completed, as eyidenced by the inyoice attached hereto as Exhibit D, which are incorporated by reference as if set out in full. l6. To date, Claimant has receiyed $563,851.75,leaying an amount outstanding of $22,250.83. 17.
