WHEREAS, Wayne E. Lindsay and Sabrina L. Lindsay of 6353 Locust Lane,
Mechanicsburg, PA 17050, is about to execute contemporaneously herewtth, a contract,
with Fred Tiday, Inc. of Mechanicsburg, PA, for the erection of a building upon premises
commonly known as 6203 Lookout Drive, Township Hampden, Cumberland County,
Pennsylvania, as set forth in the deed dated , recorded at , in the Recorder's Office for
Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is
incorporated herein and attached hereto.
NOW, August 23, 2006, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract wtth Contractor and the further consideration of One
Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN tract or parcel ofIand being situate in Township of Hampden, County of
Cumberland, and Commonwealth of Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point located on the southerly right-of-way line of Lookout Drive, said point
being a front property comer of Lot No. 60; thence along Lot 60, South 16 degrees 47 minutes 58 seconds
East (S 160 47' 58"E) a distance of241.62 feet to a point on the northerly right-of-way line of Smith Drive;
thence along said northerly right-of-way line, North 73 degrees 10 minutes 40 seconds East (N 730 10' 40"
E) a distance of 148.68 feet to a point; thence along Lot 62, North 16 degrees 39 minutes 24 seconds West
(N 16039' 24"W) a distance of229.57 feetto a point on said southerly right-of-way; thence along said right-
of-way, by a curve to the left having a radius of710.00 feet an arc distance of 150.01 feet being subtended
by a chord of South 77 degrees 47 minutes 35 seconds West (S770 47' 35"W) a distance of 149.73 feet to
a point, said point being the POINT OF BEGINNING.
