STJ:PULATION AGAINST MBCHANl:CS' LIENS
WHEREAS, H Edwin Berkheimer, Contractor, of 1314 Kuhn Road, Boiling Springs,
Pennsylvania, is to provide materials and perform labor necessary for the construction of a one story
residence with basement, upon the following tract of land located in Middlesex Township,
Cwnberland County, Pennsylvania, more specifically described as follows, to wit:
ALL that certain tract of land situate in Middlesex Township, Cumberland County, Pennsylvania,
being identified as Lot 11 as shown on a plan ofIots known as Ridge Estates, recorded in the Office
of the Recorder of Deeds, in and for Cumberland County, Pennsylvania in Plan Book 91 on Page 8,
and being more fully described as follows, to wit:
BEGINNING at a point in Ridge Drive (T-571), at a common property comer of Lot #10 and Lot
#11 of the Final Subdivision Plan for Ridge Estates; thence through said Ridge Drive (T-571) the
following three (3) courses:
1. North 80 degrees 19 minutes 39 seconds East, a distance of 91.99 feet toa point;
thence
2. By a curve, curving to the left, having a radius of 265.60 feet and an arc length of
42.64 feet (with a chord bearing of North 74 degrees 50 minutes 55 seconds East
and a chord distance of 42.60 feet) to a point; thence
3. North 61 degrees 00 minutes 00 seconds East, a distance of 66.98 feet to a point
at a common property comer of Lot #11 and Lot #12; thence along said Lot #12, South 08 degrees
42 minutes 29 seconds East, a distance of 558.85 feet to a point at a common property comer of Lot
#11, Lot #12 and lands now or late of George C. Wolfe, Jr.; thence along said lands now or late of
George C. Wolfe, Jr., South 83 degrees 45 minutes 17 seconds West, a distance of 199.98 feet to a
point at a common property comer of Lot #10, North 08 degrees 24 minutes 53 seconds West, a
distance of 520.70 feet to a point in Ridge Drive (T-571), said point being the point of
BEGINNING.
SAID LOT CONTAINING a gross area of 105,535.46 square feet (2.4228) acres and a net area of
98,739.86 square feet (2.2668 acres) to the Dedicated Right-of-Way Line of Ridge Drive (T-571).
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties as
part of the said contract and for the consideration therein set forth, that neither the undersigned
contractor, any sub-contractor or material man, nor ap.y other person furnishing labor or materials to
the said contractor under this contract shall file a lien, commonly called a mechanics' lien for work
done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary within ten
days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such
case provided.
