COMPLAINT
AND NOW, come the Plaintiffs Daniel G. Thomas and Sharon K. Thomas, by
their attorneys, Goldberg, Katzman & Shipman, P.C., who state:
1. Plaintiffs Daniel G. Thomas and Sharon K. Thomas are adult individuals
residing at 2186 Hastings Drive, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant Ace Moving and Storage, Inc., is a business entity with an office
location of 2 Laurel Road, New Cumberland, Cumberland County, Pennsylvania.
3. On or about June 14, 2000, Plaintiffs entered into a storage arrangement with
Defendant Ace Moving and Storage, Inc. for purposes of storing their household
possessions as they moved from Mt. Holly Springs, Pennsylvania. See Exhibit "A"
hereto.
4. In August, 2000, when their personal possessions were delivered to their new
home on Hastings Drive, Mechanicsburg, Pennsylvania, numerous damages had been
caused to their personal possessions.
5. These damages arose from the negligent handling of their posesions by
Defendant Ace Moving and Storage.
6. The relationship between Plaintiffs and Ace Moving and Storage was in the
nature ora bailment and the damages caused by the handling of their personal
possessions reflects a breach of that bailment by Defendant Ace.
7. As a result of the damages caused by the acts of the Defendant, Plaintiffs
have incurred damages of $10,599.22.
WHEREFORE, Judgment is demanded against Defendant Ace Moving & Storage,
Co., Inc., in the amount set forth above, together with interest and costs of suit. This is
an amount requiring submission of this claim to the arbitration pursuant to the Local
Rules of Court.

ANSWER AND NEW MATTER
AND NOW, comes the Defendant, ACE MOVING AND STORAGE, by and
through its counsel, Frederick W. Alcaro, Esquire, and hereby makes Answer to the
Complaint filed by Plaintiffs in the above matter and avers as follows:

3 Admitted and Denied. It is admitted that Plaintiffs and Defendant entered
into a Moving and Storage Contract dated June 14, 2000 attached to Plaintiffs' Complaint
as Exhibit ~A" thereto ,vhich document speaks for itself To the extent that the
averments of paragraph 3 are contrary to or inconsistent with the express terms of the
aforesaid contract, said averments are denied and strict proof thereof is demanded at trial.
4 Denied. Defendant is without sufficient information upon which to form a
belief as to the truth or t~lsity of the averments set forth in this paragraph, and, such being
the case, said averments are denied and strict proof is demanded at trial.
5 Denied. It is denied that Defendant was negligent in the handling of
Plaintiffs' possessions in any respect, and, such being the case, strict proof of Defendant's
alleged negligence is demanded at trial.
6 The averments of this paragraph set forth a legal conclusion to which no
responsive pleading is required.
7. Denied. It is denied that the acts of the Defendant in any way caused any
dalnage to the Plaintifl~ or their possessions. By way of further answer, the averments of
this paragraph tail to set forth the damages with any degree of specificity, and, being the
case, strict proof of said damages are demanded at the time of trial.
WHEREFORE, Defendant, Ace Moving and Storage, requests that Plaintiffs'
Complaint be dismissed and judgment be entered in favor of the Defendant.
NEW MATTER
The Defendant, Ace Moving and Storage, by and through its counsel, Frederick
W Alcaro, Esquire, hereby makes New Matter and avers as follows:
8 The averments set forth in DefEndant's Answers to Paragraphs 1 through 7
above, are incorporated herein by reference as though the same were more fully set forth
at length
9 On or about June 14, 2000, Defendant, Ace Moving and Storage, entered
into written Moving and Storage Contract with the Plaintiffs, to move certain of their
personal household possessions into storage at Defendant's warehouse facility in New
Cumberland, Pennsylvania, all in accordance with the terms and conditions as set forth in
said agreement, which was marked Exhibit "A' and attached to Plaintiffs' Complaint.
10. The fbllowing paragraph appears on the face of the aforesaid contract:
"INSURANCE
Customer/Shipper, for and in consideration of the moving services to
be provided by the Carrier and for other good and valuable
consideration, for himself and his heirs, legal representatives,
successors and assigns, does hereby release Carrier, its affiliates,
employees, heirs, legal representatives, successors and assigns from all
liability or actions for damages for any reason whatsoever in excess of
30 cents per pound per article in case Customer sustains any loss or
damage to his goods being moved by Carrier. Customer/Shipper is
protected only up to but not exceeding 30 cents per pound per article.
Such limitation of liability to 30 cents per pound per article is in
accord with Chapter 31 of the Public Utility Commission Regulations.
Customer has been given the opportunity to purchase insurance from
Carrier for his articles to cover loss or damage to his goods in excess of
the 30 cents per pound per article limitation. By signing this Release,
Customer is waiving his/her opportunity to purchase insurance from
Carrier unless Carrier receives written notice from Customer prior to
the date of the packing of the moving or the move, which ever is
earlier, informing Carrier that he/she wishes to purchase insurance.

11. Plaintiff} DANIEL G. THOMAS, by signing the line below the above
paragraph specifically acknowledged: (i) the 30 cent per pound per article limitation for
damage to his possessions; (2) the opportunity to purchase insurance from the Defendant
to cover any damage in excess of the 30 cent per pound per article limitation; and (3) and
his waiver of the opportunity to purchase said additional insurance coverage from
Defendant.
12. Assuming arguendo that Plaintiffs are able to prove at thai that certain of
their possessions were damaged and that the damage was due to the negligence of
Defendant, their recovery is limited to 30 cents per pound per article so damaged.
WHEREFORE, the Defendant, Ace Moving and Storage. respectfully requests
that Plaintiffs' Complaint be dismissed and judgment entered in favor of the Defendant.
