referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
si tuate in Hampden Township, CU1l1berland County, Cormnonweal th of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #38, 5041
Pe11ingham Circ1e, Mechanicsburg, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself,' himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic'S liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or lot of land situate in Spring Township, Perry County,
Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin within the center of the intersection of Township Road T -315
(33 feet wide) and of Township Road T-305 (33 feet wide); thence following the centerline of
Township Road T-305 North 53 degrees 30 minutes 58 seconds West, a distance of 60.65 feet
to an iron pin; thence North 72 degrees 27 minutes 12 seconds West, a distance of 307.15
feet to an iron pin on said centerline at the dividing line of Lot 1 residue of Charles E. Haley
and Lot 4 herein conveyed as shown on the hereinafter mentioned Subdivision Plan; thence
along Lot 1 residue North 24 degrees 27 minutes 20 seconds East passing through a concrete
monument 35.00 feet from beginning point, a distance of 178.60 feet to a concrete
monument; thence South 65 degrees 32 minutes 40 seconds East, a distance of 372.30 feet
passing through a concrete monument 30.00 feet from end point, to an iron pin within the
centerline of aforementioned Township Road T-315; thence following the centerline of said
Township Road T-315 South 27 degrees 26 minutes 52 seconds West, a distance of 154,50
feet to an iron pin within the center of the aforementioned intersection of Township Road
T-315 and of Township Road T-305, the place of BEGINNING.
CONTAINING an area of 1.337 acres and being Lot 4 as shown on the Final Subdivision
Plan for Charles E. Haley prepared by Stephen P. Reisinger, Surveyor, dated January 3,
2995, recorded in Perry County Recorder of Deeds in Plan Book 42, Page 56.
