WHEREAS, Douglas M. Byer and Roni J. Byer, of 814 Briarwood Lane, Camp Hill, PA
17011, is about to execute contemporaneously herewith, a contract, with C & C Residential
Builders, Inc. of P. O. Box 2434, Mechanicsburg, PA 17055, for the erection of a building
upon premises commonly known as Lot 2A Beard Road, Township Silver Spring,
Cumberland County, Pennsylvania, as set forth in the deed dated 12/20/01, recorded at
Book 249, Page 4194, in the Recorder's Office for Cumberland County, Pennsylvania, as
more specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, September 1, 2006, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said
Contractor to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Contractor and the further
consideration of One Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien
shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens
being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THA T CERTAIN tract or parcel of land situate in Silver SDrinQ Townshio,
Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and
described as follows:
BEGINNING at a point, which point is located on the dedicated right-at-way line
of Beard Road at the dividing line of Lots No.2 and 3 as depicted on the below
referenced Final Subdivision Plan; thence from said point along the aforementioned
dedicated right-of-way line of Beard Road North 11 degrees 34 minutes 4 seconds
West, a distance of 259. 53 feet to a point; thence continuing along said right-of-way
line by a curve to the right having a radius of 50. 00 feet and an arc distance of 86. 02
feet to a point; thence continuing on said right-ol-way line North 87 degrees 00
minutes 27 seconds East a distance 01224.64 feet to a point on the dividing line of
Lot No. 1 and Lot No.2 on the below referenced Final Subdivision Plan; thence by
said dividing line South 78 degrees 25 minutes 56 seconds West, a distance of
315.24 feet to a point on the dedicated right-of-way line of Beard Road, the place of
BEGINNING. CONTAINING 2.00 acres.
BEING Lot No. 2 as shown on the Final Subdivision Plan of the Estate of
Blanche M. Beard, as recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, on December 21, 2000 in Plan Book 82, Page 73.
