STIPULATION AGAINST LIENS

THIS AGREEMENT made this R day of ~J2!t?nhe::J<-. 2006, by and
between Roger Russell Builder, sole proprietor, of Newville,
Cumberland County, Pennsylvania, hereinafter referred to as
Contractor,
AND
BILLY B. SHEAFFER, JR. AND SANDRA L. SHEAFFER, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Penn Township, Cumberland County, Commonwealth
of Pennsylvania, and more fully described in Exhibit II A" which is
attached hereto and made a part hereof known as Lot #16 Cela
Crossings, 7 David Glenn Drive, Penn Township, Carlisle, PA.
NOW THEREFORE, THIS AGRE~NT WITNESSETl{:,~, ; That the said
Contractor, for an in consideration of the sumol'A$l:t..oO) Dollar to
Contractor in hand paid by-~.owner, the receipt'whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN lot or tract of land situate in the Township of Penn, County of
Cumberland and State of Pennsylvania, designated as Lot "16" as shown on Subdivision
Plan entitled "Final Subdivision Plan for Cela Crossings" prepared by Eric L. Diffenbaugh,
Professional Land Surveyor, dated June 3, 2004, revised June 23, 2004, which plan has been
approved by the appropriate municipal authorities as a final Subdivision Plan, and which is
recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Plan Book 89, Page 104, and is bounded and described as follows:
BEGINNING at a set iron pin along the southern right-of-way line of David Glenn Drive at
the dividing line between Lot 16 and Lot 17 on the hereinabove-referenced plan; thence
along said dividing line South 41 degrees 07 minutes 14 seconds East 421.33 feet to a set iron
pin; thence along line of lands now or formerly of Edward L. Ege and Deborah N. Ege
South 51 degrees 59 minutes 33 seconds West 237.91 feet to a set iron pin; thence along the
dividing line between Lot 15 and Lot 16 on the hereinabove-referenced plan North 41
degrees 07 minutes 14 seconds West 394.31 feet to a set iron pin; thence along the southern
right-of-way line of David Glenn Drive North 45 degrees 29 minutes 02 seconds East 237.98
feet to a set iron pin, the point and place of BEGINNING.
