HomeMy WebLinkAbout02-2212STIPULATION AGAINST LIENS THIS AGREEMENT made the 2nd of May, 2002, by and between THE McNAUGHTON COMPANY, ~o,~,~-ie,~c.-ro,( MICHAEL G. KRNJAIC and LEAH M. KRNJAIC, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Situated in Upper Allen Township, Cumberland County, Pennsylvania, and bounded and described as per attached legal: NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to THE McNAUGHTON COMPANY in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Signed, Sealed and Delivered in the Presence of by: - ; i COMPANY ~. ~C~ (Seal) ./~//~. 63 ~ (Seal) (Seal) ALL THAT CERTAIN piece, parcel or lot of land situate in Upper Allen Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Eastern right-of-way line of Canterbury Drive (50.00 feet wide), said point'being located at the Southewestern corner of Lot NO. 162; thence along the Southern boundary line of Lot No. 162, South 51 degrees 04 minutes 01 second East, for a distance of 154.93, to a point on the right-of-way line of Gettysburg Pike (T-621) (36.00 foot legal · right-of-way); thence along said right-of-way line South 39 degrees 19 minutes 58 seconds West, for a distance of 80.00 feet, to a point at the Northeastern corner of Lot No. 133; thence along the Northern boundary line of Lot No. 133, North 51 degrees 04 minutes 01 second West, for a distance of 154.93 feet, to a point on the Eastern right-of-way line of Canterbury Drive (50.00 feet wide); thence along said right-of-way line North 38 degrees 56 minutes 00 seconds East, for a distance of 80.00 feet, to a point and the place of BEGINNING. CONTAINING approximately 12,394.40 square feet of land, and being known and numbered as Lot No. 134 on the Final Subdivision Plan for Canterbury Estates, Phases VII and VIII, which is recorded in Cumberland County in Plan Book 77, Page 100. I/N-DER AND SUBJECT to any and all covenants, conditions, restrictions, reservations, agreements, easements, and rights of way of record. BEING PART OF THE SAME PREMISES Which The McNaughton Company, a Pennsylvania corporation, by their deed to be recorded simultaneously herewith, in the office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Michael G. Krnjaic and Leah M. Krnjaic.
