Fitzpatrick, of Pennsylvania, is about to execute contemporaneously herewith, a contract with Fitzpatrick Construction of Cumberland County, Pennsy Ivania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN tract of land situate in Monroe Township, Cumberland County, Pennsylvania, bounded and described as Lot 8 according to a Final Subdivision Plan ofNoss Farm for Raymond Diehl prepared by Larry V. Neidlinger, P.E., August 24, 1977 and recorded in Cumberland County, Pennsylvania Plan Book 35, Page 128, as follows, BEGINNING at a point along the right of way line of Martin Road (T-553) at the dividing line of Lot No.8 herein conveyed and Lot No.9 as shown on the aforementioned Subdivision Plan; thence along Lot No.9 North 87 degrees 30 minutes West, a distance of 200.00 feet to a point on other lands now or formerly of Raymond Diehl; thence along lands of Raymond Diehl North 02 degrees 30 minutes East, a distance of 100.00 feet to a point on the dividing line of Lot No.7 and Lot No.8; thence along Lot No.7 South 87 degrees 30 minutes East, a distance of 200.00 feet to a point on the right of way of aforementioned Martin Road (T-553); thence along said right of way South 02 degrees 30 minutes West, a distance of 100.00 feet to a point, the Place of BEGINNING. CONTAINING 20,000.00 square feet exclusion of dedicated right-of-way. NOW, the \ ~ 0--....-day of September, 2006, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Scott A. Fitzpatrick to the said Fitzpatrick Construction to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Fitzpatrick Construction and the further consideration of One Dollar, to Fitzpatrick Construction paid by Scott '- .., A. Fitzpatrick it is agreed that no lien shall be filed against the building by the contractor, or any sub- contractor, nor by any ofthe material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
