HomeMy WebLinkAbout06-5358 STIPULATION AGAINST LIENS LAWMEN CONSTRUCTION, LLC, Owner IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA versus DiP - .5358 MLD TERM LAWMEN CONSTRUCTION, LLC, Contractor Whereas, LA WMEN CONSTRUCTION, LLC, a Pennsylvania Limited Liability Company, of 149 Kerrs Road, Carlisle, Cumberland County, Pennsylvania is about to execute contemporaneously herewith, a contract with LA WMEN CONSTRUCTION, LLC, a Pennsylvania Limited Liability Company, of 149 Kerrs Road, Carlisle, Cumberland County, Pennsylvania, for the erection of a residential dwelling house upon a lot ofland situate in West Pennsboro Township, Cumberland County, Pennsylvania, being known as Lot No. 4 on the PreliminarylFinal Subdivision Plan for Penn Knoll dated February 22, 1990, by Rettew Associates, Inc., and recorded in the Office of the Recorder of Deeds in and for Cumberland County in Plan Book 60, Page 90. Legal Description: BEGINNING at a rebar in Kerrs Road T-442 at the dividing line between Lots 3 and 4 of the above referenced plan; thence by said dividing line, North 15 degrees 05 minutes 03 seconds East 302.41 feet to a concrete monument set; thence by the dividing line between Lots 4 and 8 of the above referenced plan, North 69 degrees 56 minutes 20 seconds East 87.77 feet to a point; thence by lands now or formerly of Charles W. Robinson, South 20 degrees 33 minutes 28 seconds East 245.00 feet to a railroad spike; thence by Kerrs Road T- 442, South 69 degrees 26 minutes 33 seconds West 263.99 feet to a rebar, the place of BEGINNING. Now, September 5, 2006, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration ofthe making of the said contract with it and the further consideration of one Dollar, to Contractor paid by Owner it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any ofthe material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
