THIS AGREEMENT mede the _;~ of May, 2002, by and between
D. Cully, Inc., t/a
C & C Construction
hereinafter referred to as Contractor,
AND
Anthony D. Caldwell and Kelly E, Caldwell,
herelnatter referred to aa Owner,
whereby the former undertook and agreed to erect and construct a single family
residence on that ~ertaln tot of ground known aa:
All that certain unimproved tract of land situate in South Middllton Township,
Cumberland County, Pennsylvania, being known and numbered as Lot 9 In Land
SubdNIslon Plan for John N. Mallio~ as recorde~l in Plan Book 85, Page 6.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and In consideration of the sum of One and 00/100 Dollar ($I .00) to
Contractor in hand paid by Owner, the receipt whereof ia hereby acknowledged, and
the further consideration mentioned in the agreement aforesaid, for themselves and
their aul~ontra~tora, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the ~aid buildings and the lot of ground appurtenant thereto for or on account of
any wo~ done or materials furnished by them or any of them under said contract or
othent~e, for, towards, in, or about the ere~ion and constructio~ of the said buildings
on the lot above described, and the said Contractor, for themselves, their
subcontractors and othem under them hereby expressly waive and relinquish the right
to have, fill, and malntaln any mechanic's liens or claims against the said buildings or
any of them, and agree that this instrument, waiving the right of lien, shall be an
independent Covenant,
