COMPLAINT
1. Plaintiff. CHASE MANlIATTEN BANK. USA, IS a corporation located 111
Wilmington, Delaware.
2. Defendant is an adult individual with a last known address or 4021 Cherokee Ave,
Camp Hill,Pa 17011.
3. Defendant entered into a Cardmembcr Agreement for a nedit card bearing the account
number 4104140010919414. A true and correct copy of the Cardmember Agreement is attached hereto,
marked as Exhibit "1" and made a part hereof.
4. This account was subsequently assigned to Plaintiff for value.
5. The Cardholder Agreement contains a provISIon to settle by arbitration any claim,
dispute or controversy arising from or relating in any way to the Cardholder Agreement.

6. Defendant made use or said I.:rcdit card and has currently a balance due and owing to
Plaintiff, as of August 9, 2006, in the amount of $6,4XO.:W.
7. Defendant is in default of the terms of the cardholder Agreement having not made
monthly payments to Plaintiff thereby rendering the entire balance immediately due and payable.
8. Plaintiff avers that the Cardholder Agreement between the pa11ies provides that
PlaintitT is entitled to the addition of finance charges at the rate of 6.0% per annum on the unpaid
balance.
9. Although repeatedly requested to do so by Plaintiff, DetCndant has willfully failed
and/or refused to pay the principal balance. financc chargcs or an) part thercorto Plaintiff.
WHEREFORE. Plaintiff demands Judgment in its l~lvor and against Defendant, Torrence R
Quesenberry individually, in the amount of S6,480.20 with continuing finance charges thereon at the
rak of 6.0% per annum from August 9, 2006 plus costs; or in the altemative, an order directing the
parties to arbitrate this dispute pursuant to the terms contained in the Cardholder Agreement.
