COMPLAINT
Plaintiffs, Michael and Roxanne Beard, by their attorneys, Gates, Halbruner & Hatch, P.C.,
file this Complaint demanding payment for outstanding amounts due under an Agreement, alleging
in support thereof the following:
I. Plaintiffs, Michael and Roxanne Beard, are adult individuals, residents of the state
of Ohio, and having a mailing address of 1421 Lexington Avenue, Number 143, Mansfield, Ohio
44907.
2. Defendants, Mark and Janice Panty, are adult individuals trading or doing business
together as MJ Enterprises, residents of the Commonwealth of Pennsylvania, and having a mailing
address of Newberry Commons, Etters, Pennsylvania 17319.
3. On or about October 12, 2005, the Defendants obtained a loan from Beards in the
original principal amount of $15,000.00 (the "Loan"), as evidenced by a signed, dated, and
notarized agreement (the "Agreement"), a copy of which is attached hereto as Exhibit "A" and
incorporated herein by reference.

4. The initial Loan was accepted and received by both Defendants, as indicated by their
joint endorsement of the Loan check, a copy of which is attached hereto as Exhibit "B" and
incorporated herein by reference.
5. Under the terms and conditions of the Agreement, the Defendants agreed to repay by
June 30, 2006 the principal balance of the Agreement, together with interest and profit, at the total
sum of $30,000.00 due.
6. The Defendants are in default of their obligation to make payment of the amounts
due to the Plaintiffs under the Agreement, for, inter alia, failure to make any payments due to the
Plaintiffs under the terms and conditions of the Agreement.
7. Despite Plaintiffs' demands, the Defendants have failed and continue to fail to make
payments of all amounts due to Beards under the terms and conditions of the Agreement.
WHEREFORE, Plaintiff, Michael and Roxanne Beard, demands judgment against
Defendants, Mark and Janice Panty, t/d/b/a MJ Enterprises, in the amount of $30,000.00. Which
amount is below the threshold requiring referral to arbitration, and such other relief as the Court
deems equitable and just.
