STIPULATION AGAINST LIENS
WHEREAS, TRACEY GILL MCCALL, the OWNER of the real estate described below, has or is about to execute a
contract with KEITH A. BAREFOOT CUSTOM HOMES, whose principal business address is 144 MILLERS GAP
ROAD, ENOLA, PA 17025, to construct a single family dwelling upon lands situate at 5655 HILLSIDE LANE,
MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA, and more particularly bounded and described
on Exhibit "A" attached hereto and made a part hereof; and,

NOW, THEREFORE, this -1L day of ~bef, 2006, before any authority had been given by
KEITH A. BAREFOOT CUSTOM HOMES to commence work on said facilities, or purchase materials for same, in
consideration of making of the above-described Contract with TRACEY GILL MCCAll, Owner, and in further
consideration of One ($1.00) Dollar paid to the general contractor by TRACEY Gill MCCALL, Owner, the receipt
whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or maintained against the
Owner's facilities and the land above-described, or upon TRACEY Gill MCCALL, the Owner, by the general
contractor, or any of its subcontractors, or by any of the materialmen or workmen, or any other person acting
through or under therl, for or on account of any labor, or materials purchased, or extra labor or materials
purchased for, toward~, in or about the erection, construction, design and improvement of said facilities, under
said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, the land
above-described, and TRACEY Gill MCCALL, the Owner, being hereby expressly waived by the general
contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them.
IN WITNESS WHEREOF, each of thwarties by their duly aythorized representatives have hereunto

ALL THAT CERTAIN piece or parcel of land situate in Hampden
Township, CUmberland County, Pennsylyania, bounded and described
as follows, to wit:
BEGINNING at a point on the eastern line of an 18 Foot
Private Road at corner of lands late of Nora A. Aughinbaugh;
thence along lands late of Nora A. Aughinbaugh south 72 degrees
45 minutes east ninety nine and fiye-tenths (99.5) feet to a
point 10 feet from the Conodoguinet Creek; thence north 17
degrees 15 minutes east one hundred (100) feet to a point 10 feet
from the Conodoguinet Creek; thence north 25 degrees 15 minutes
east fifty (50) feet to a point 10 feet from the Conodoguinet
Creek; thence along lands now or late of Carol E. Brightbill
north 64 degrees 45 minutes west ninety nine (99) feet to a point
on the easte::rn line of the aforesa~d,18 Foot Private Road; thence
along the eastern line of said 18 Foot Private Road south 26
degrees 45 minutes west fifty (50) feet to a point; thence along
the eastern line of said 18 Foot Private Road south 17 degrees 15
minutes west one 'hundred fifteen and three-tenths (115.3) feet to
a point, the place of BEGINNING.
HAVING thereon erected a frame cottage with aluminum siding.
The said Grantee, her heirs and assigns. shall also have the
right and privilege, in common with the said Grantors, their
heirs and assigns, to use as a passageway a certain strip of land
ten (10) feet in width lying between the said Creek and the lot
of ground above described; this privilege of a passageway is also
subject to the rights of other persons to whom certain privileges
of passing along the bank of said Creek have already been given.
and to such persons as said Grantors may hereafter give such
privileges.
The said Grantee, her heirs and assigns, shall also haye the
right and privilege, in common with the said Grantors, their
heirs and assigns, and all other persons to whom said priYilege
has been given or hereafter may be given by said Grantors, to use
a certain Private road as laid out by Thomas M. Moyer, eighteen
(18) feet in width, and extending 'from the land hereby conveyed
to the public road leading to Bryson's Bridge.
The said Grantee, her heirs and assigns, shall also pave the
right and privilege, in common with the said' Grantol.~s', ,their
heirs and assigns, and all other persons to whom said privilege
has been given or hereaf~er may be given by said Grantors, to use
a certain Well located on other lands of the said Thomas M. Moyer
near said eighteen {la} foot Private road.
UNDER AND SUBJECT to all restrictions, easements, covenants,
conditions and agreements of record
