SPANGLER Defendants : 1N THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA ::N°' : CIVIL ACTION - LAW : IN MORTGAGE FORECLOSURE COMPLAINT IN MORTGAGE FORECLOSURE The Plaintiff, PENNSYLVANIA STATE BANK, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendants, WINSTON E. SPANGLER and KARLYN K. SPANGLER, to recover the sum of FOUR HUNDRED FIFTY-SEVEN THOUSAND, TWO DOLLARS AND FIFTY-EIGHT CENTS ($457,002.58), along with interest thereon at the per diem rate of $107.22428 from May 1, 2002, upon a cause of action of which the following is a statement: 1. The Plaintiff, PENNSYLVANIA STATE BANK, is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 2148 Market Sl~eet, Camp Hill, Cumberland County, Pennsylvania 17001-0487. 2. The Defendant, WINSTON E. SPANGLER, is an adult individual residing at 515 Poplar Avenue, New Cumberland, Cumberland County, Pennsylvania 17070. 3. The Defendant, KARLYN K. SPANGLER, is an adult individual residing at 515 Poplar Avenue, New Cumberland, Cumberland County, Pennsylvania 17070. 4. On or about July 9, 2001, in order to induce Plaintiff to loan certain monies to Defendants, Defendants did execute a Mortgage securing property known as 435 Market Street, Borough of Lemoyne, County of Cumberland, Pennsylvania, as referenced in Deed Book 101, Page 101, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, to Plaintiff, in the amount of Three Hundred Sixty-Three Thousand, Two Hundred Ten Dollars and Ninety-Seven Cents ($363,210.97), with interest thereon. A true and correct copy of said Mortgage is attached hereto, marked as Exhibit "A" and made a part hereof. 5. Defendants have defaulted on the payment terms of the aforesaid Mortgage, and Defendants are indebted to Plaintiff in the amount of One Thousand, Two Hundred Ninety-Six Dollars and Twenty-Four Cents ($1,296.24) for late charges. 6. As of May 1, 2002, Defendants are indebted to Plaintiff in the sum of Three Hundred Eighty-Thousand, Eight Hundred Thirty-Five Dollars and Forty-Eight Cents ($380,835.48). 7. Due to Defendants' default in the payment terms as aforesaid, interest has been accruing, and continues to accrue, at the rate of $87.89118 per diem. 8. The Defendants' loan on said Mortgage is due and owing for the months of November and December, 2001, January, February, March, April and May, 2002. 9. As this is a commercial property, no Act 6 and Act 91 Notices are required. 10. Pursuant to the terms and conditions of the Mortgage attached hereto at Exhibit "A" and made a part hereof, Defendants are further liable for attorney's fees, which are added to the account in the amount of Seventy-Six Thousand, One Hundred Sixty-Seven Dollars and Ten Cents ($76,167.10). 11. The balance due and owing to Plaintiff by Defendants is the sum of Four Hundred Fifty-Sevan Thousand, Two Dollars and Fifty-Eight Cents ($457,002.58). 22. Plaintiff has frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants have refused and neglected and still refuse and neglect to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of FOUR HUNDRED FIFTY-SEVEN THOUSAND, TWO DOLLARS AND FIFTY-EIGHT CENTS ($457,002.58), together with interest thereon at the rate of $87.89118 per diem from May 1, 2002 and such other relief as this Honorable Court deems just.
