Jerry W. Swartz, hereinafter referred to as Contractor,
Michael Reborchick and Hope Reborchick, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in South Middleton Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#53 Sunset Drive, Mount Holly Springs, Cumberland County, PA.
NOW TREREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractom~. ~or.a~ in consideration of the sum of ($1.00) Dollar to
Contractor in. hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their Subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said bull

hereby expressly waiv~ and relinquish the right to have, file, and
intain any mechanic s liens or claims against the said buildings

ALL THAT CERTAIN tract of land situate in South Middleton Township,
Cumberland County, Pennsylvania, bounded and described in accordance with a
Plan prepared by Statler-Brehm Associates, Inc. dated October 15, 1996 and
recorded in the Office of the Recorder of Deeds for Cumberland County in Plan
Book 76, Page 56.
BEGINNING at a point on southern right of way line of Sunset Drive at Lot No. 52;
thence along Sunset Drive North 80 degrees 26 minutes 15 seconds East 90.00 feet to
a point; thence along Lot No. 54 North 09 degrees 33 minutes 45 seconds East 140.00
feet to a point; thence along Lot No. 47 and 48 South 80 degrees 28 minutes 15
seconds West 90.00 feet to a point; thence along Lot No. 52 South 09 degrees 33
minutes 45 seconds West 140.0 feet to a point, the Place of BEGINNING.
Designated as Lot No. 53 on Plan of South View Estates.
