THIS AGREEMENT made and concluded this ~~ day of September, 2006,
between Raymond T, Carey and Deborah L. Carey, of 108 3rd Street, Boiling Springs,
Cumberland County, Pennsylvania, 17007 party of the first part (hereinafter called
Owner), and Mark Ludt Building, Inc. ofP.O, Box 128, Boiling Springs, Cumberland
County, Pennsylvania, party ofthe second part (hereinafter called Contractor).
WEHREAS, the said parties have by a duly executed Agreement under seal, dated
June 26, 2006 entered into a written contract for the construction and completion of a
single-family dwelling located at 53 Heisers Lane, South Middleton Township, Carlisle,
Pennsyl vania.
NOW THIS AGREEMENT WITNESSETH, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by
the said Owners to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar, to Contractor paid by Owners, it
is agreed that no lien shall be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
