HomeMy WebLinkAbout02-2307STIPULATION AGAINST LIENS THIS AGREEMENT made the 6th of May, 2002, by and between HOFFMAN'S CUSTOM CONTRACTING, GARY KELLER and ANNA M. KELLER, hereinafter referred to as Owner, whereby the fo~mer undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Dickinson Township, Cumberland County, as per attached legal: NOW THEREFORE, THIS AGREEMENT WITNESSE'r~: That the said Contractor, for and in consideration of the sum of ($I.00) Dollar to HOFFMAN'S CUSTOM CONTRACTING in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Phillips, Jr. and Edna Lucille Phillips, consisting of two pages prepared by Stephen G. Fisher, a registered surveyor, dated August 8, 1987, a copy of which is recorded in the hereinafter Recorder's Office in Plan Book 54 at Pages 4 and 4-A, as follows: BEGINNING at a point in the original center line of 33 feet wide L. R. 21008, known as Pine Road, at the dividing line between Lots Nos. 9 and 10; thence from said point at the place of beginning along said original center line of 33 feet wide Pine Road, North 82 degrees 30 minutes 45 seconds East a distance of 185.00 feet to a point at the dividing line between Lots Nos. 1 and 10; thence along said dividing line between said Lots Nos. 1 . and 10, South 07 degrees 29 minutes 15 seconds East a distance of 300.00 feet to a 6oncrete monument; thence still along the dividing line between said Lots Nos. 1 and 10, South 82 degrees 30 minutes 45 seconds West a distance of 185.00 feet to a point at the dividing line between said Lots Nos. 9 and 10; thence along said dividing line between said Lots Nos. 9 and 10, North 07 degrees 29 minutes ~5 seconds West a distance of 300.00 feet to a point in'the~original center line of 33 feet wide Pine Road at the Place of BEGINNING. THE ABOVE-DESCRIBED tract of land is all of Lot No. 10 as shown on said Final Subdivision Plan for Linwood B. Phillips, Jr. and Edna Lucille Phillips recorded as aforesaid, and contains a net area exclusive of the dedicated right-of-way of Pine Road of 1.1467 acres. ~ .THE NORTHERNMOST 30 feet of the above described lot of land has been dedicated as a portion of the right-of-way of said Pine Road as shown on said Final Subdivision Plan recorded as aforesaid. UNDER AND SUBJECT, NEVERTHELESS, to the building and use restrictions shown on and set forth on the above-mentioned Final Subdivision'Plan of Kings Gap Estates, recorded as aforesaid, and to easements visible or of record which shall be binding upon the within-described tract of land only and shall not be deemed binding on other land of Linwood B. Phillips, Jr. and wife, with which building and use restrictions the within Grantees, their heirs and assigns, by the acceptance of this deed, agree to comply. ALSO UArDERAND SUBJECT TO any and all covenants, conditions, restrictions, agreements, easements, and rights-of-way of record. BEING PART OF THE SAME PREMISES which L. B. Phillips, Jr., by his deed to be recorded simultaneously herewith, in the office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Gary Keller and Anna M. Keller.
