THIS AGREEMENT made the 9th day of May, 2002, by and between Yanek Custom Homes,
Inc, hereinafter referred to as Contractor, and Michael C. Chronister and Deborah L. Chronister,
hereinafter referred to as Owner, whereby the framer undertook and agreed to erect and construct
a custom built home on that certain lot of ground situate at Lot 65 of the Final Subdivision Plan of
Rockwell Farms located on Bumthouse Road, Carlisle, Dickinson Township, Cumberland County,
Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

Yanek, known to me to be the person whose name is subscribed, and who acknowledges himself to
be the Sole Proprietor of Yanek Custom Homes, Inc. and that he as such owner, being authorized
to do so, executed the foregoing statement for the purposes therein contained by signing the name
of the business by himself as the owner.

ALL that certain tract of land situate in Dickinson Township, Cumberland County, Pennsylvania,
and more particularly identified as follows:
LOT NO. 65 on the Final Subdivision Plan of Rockwell Farms, recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 63, Page 79, et. seq.,
the metes and bounds description for which lot is attached hereto as Exhibit "A" incorporated herein
by reference and made a part hereof.
UNDER AND SUBJECT, NEVERTHELESS, to the conditions, restrictions and easements as noted
on the hereinabove mentioned Final Subdivision Pin.
BEING a part of the same premises which Jean E. Rockwell, widow, by her deed dated November
1, 1991 and recorded November 1, 1991 in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania in Deed book "J", Vol. 35, Page 385, granted and conveyed to
Rockwell Farms, a Pennsylvania General Partnership composed of William M. Kronenberg, Norman
L. Rynard and Wayne E. Statler. By Assignment of interest dated February 8, 1994, and recorded
in Misc. Book 465, Page 1166, Wayne E. Statler assigned his interest to Willliam M. Kronenberg,
Norman L. Rynard and Donald A. Group, Grantor herein.
