STIPULATION AGAINST MECHANICS' LIENS
WHEREAS, Anil . Parikh and Nayana A. Parikh, 1800 Harrisburg Pike, Carlisle,
Pennsylvania, 17013, (hereinafter referred to as the "Owners"), presently own, in fee simple, a
tract of unimproved land known as Lot 52, 1286 Summit Way, Mechanicsburg, Hampden
Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A"
AND WHEREAS, the Owners have, on August 31, 2006, entered into an agreement with
Carlson Construction, Inc., 1208 Summit Way, Mechanicsburg, Pennsylvania, 17050,
(hereinafter, whether one or more, designated as the "Contractor", and referred to in the singular,
and masculine gender), whereby the Contractor is to furnish all labor, materials, scaffolding,
machinery, equipment, utility services, power, transportation and other things necessary for the
complete construction of a single family residence on the above described real estate in
accordance with plans and specifications agreed upon between the parties
AND, WHEREAS, as part of the consideration for said agreement the Contractor has
agreed with the Owner/s that neither the Contractor nor any sub-contractors or materialmen may
or shall file any mechanics' liens against said real estate in connection with the above described
construction or improvement.
NOW THIS AGREEMENT WITNESSETH, that in consideration of said building
contract, and in further consideration of ONE DOLLAR paid by the Owner/s to the Contractor
before the execution hereof, receipt of which is hereby acknowledged, the Contractor hereby
agrees that he will not file, and that no sub-contractor, laborer, materialman or other person or
party shall be permitted to file, any mechanic's lien against the aforesaid building or
improvement, or against the above described land, for any labor, materials or services furnished
to or for, or performed upon, said premises, building or improvements: said right of lien being
hereby expressly waived.

AND FURTHERMORE, the Contractor hereby acknowledges that no authority has been
given him by the Owner/s to commence work on said construction improvement prior to the date
of this stipulation, and that neither he nor any sub-contractor, laborer or materialman working
under or for him or with his knowledge or consent, has heretofore performed any work of any
nature whatsoever in connection with said construction or improvement, or ordered or purchased
materials therefor.
IN WITNESS WHEREOF the Contractor, intending to be legally bound, has executed
this Stipulation and Waiver, in duplicate original copies, this .2.91'- day of ~~

ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the northern right-of-way line of Summit Way that is located at the
southwestern comer of Lot #51 being the northwestern comer of Lot #52; thence, along Lot #51 North sixty-one
(61) degrees fifty-six (56) minutes fourteen (14) seconds East by a distance of two hundred ninety-four and
sixteen hundredths (294.16) feet to a point; thence, along the western right-of-way of Route 581 South thirty-six
(36) degrees fifty-two (52) minutes thirty-one (31) seconds East by a distance of one hundred eleven and thirty-
one hundredths (111.31) feet to a point; thence along Lot #53 South sixty-one (61) degrees fifty-six (56)
minutes fourteen (14) seconds West by a distance of two hundred fifty-five and sixty hundredths (255.60) feet to
a point on the northern right-of-way line of Summit Way; thence along the northern right-of-way line of Summit
Way on a curve to the left with a radius of four hundred five and zero hundredths (405.00) feet with a arc length
of one hundred seven and ten hundredths (107.10) feet having a chord with a distance of one hundred six and
seventy-nine hundredths (106.79) feet and a chord bearing North fifty-nine (59) degrees twenty-five (25)
