WHEREAS, Owner is about to execute a contract with Contractor for the erection
of a building upon a lot of land situate in East PennsboroTownship, Dauphin County,
Pennsylvania, more particularly bounded and described on Exhibit A attached hereto.
NOW, May 14, 2002, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said
Contractor to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Contractor and the further
consideration of One Dollar to it paid by Owner, it is agreed that no lien shall be filed
against the building by the Contractor or any sub-contractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.
WITNESS our hands and seals the day and year aforesaid.

ALL THOSE CERTAIN tracts or parcels of land, with improvements thereon erected,
situate in East Pennsboro Township, Cumberland County, Pennsylvania, being more
particularly bounded and described in accordance with a Preliminary/Final Subdivision
Plan for Hildebrandt Estate, prepared by Herbert, Rowland & Grubic Inc. and recorded in
Cumberland County Plan Book 51, page 40, as follows, to wit:
Tract No. 1:
BEGINNING at a point on the northern right of way line of College Hill Road (60 foot
fight of way) and the eastern fight of way line Of"B" Street (50 foot fight of way); thence
along the fight of way line of B Street the following courses and distafices: (1) along a
curve to the right having a radius of 17 feet, a delta of 88 degrees 23 minutes 32 seconds,
an are length of 26.23 feet to a point; (2) North8 degrees 45 minutes 43 seconds East
183.43 feet to a point; (3) along a cure to the let~ having a radius of 295 feet, an are
length of 112.14 feet to a point; (4) North 13 degrees 01 minute 00 seconds West 40.77
feet to a point; thence along lands now or formerly of Ross Gutshall, the following
courses and distances: (1) North 76 degrees 59 minutes 00 seconds East 27.98 feet to a
point; (2) South 16 degrees 19 minutes 00 seconds East 338.15 feet to a point; (3) North
79 degrees 30 minutes East 65.00 feet to a point; (4) North 60 degrees 49 minutes 00
seconds East 298.50 feet to a point; (5) North 79 degrees 27 minutes 00 seconds East
449.35 feet to a point; thence along lands now or fomxerly of George Boyer South 46
degrees 14 minutes 00 seconds East 497.37 feet to a point; thence along lands now or
formerly of Rube Moore South 46 degrees 40 minutes 00 seconds West 391.51 feet to a
point on the northern right of way line of College Hill Road; thence along said right of
way line No~h 69 degrees 59 minutes 00 seconds West 789.22 feet to a point; thence
continuing along said fight of way line along a curve to the lef~ having a radius of 1480
feet, an arc length of 248.24 feet to a point, being the place and point of BEGINNING.
Tract No. 2:
BEGINNING at a point on the northern right of way line of College Hill RJoad and the
southeastern corner of a lot now or formerly of Charles and Shiela Sawyer; thence along
the eastern line of said Sawyer lot North 21 degrees 22 minutes 00 seconds West 113.69
feet to a point on the southeastern corner ora lot now or foimerly of William and Patricia
Sullivan; thence along the eastern line of said Sullivan lot North 22 degrees 50 minutes
00 seconds West 140.72 feet to a point on the southern fight of way line of Valley Street
(30 foot dedicated right of way); thence along the right of way line of Valley Street,
North 67 degrees 10 minutes East 523.09 feet to a point; thence continuing along said
fight of way line North 84 degrees 49 minutes East 444.04 feet to a point; thence along
lands now or formerly of Dewey, Mecldey & Harrisburg Dairies, South 5 degrees 48
minutes 00 seconds East 175.38 feet to a point; thence South 83 degrees 00 minutes 00
seconds East 105.12 feet to a point on the western fight of way line of B Street; thence
along said fight of way line South 08 degrees 45 minutes 43 seconds 89.78 feet to a point;
thence continuing along said right of way line along a curve to the right having a radius
of 17.00 feet, a delta of 88 degrees 23 minutes 32 seconds an arc length of 26.23 feet to a
point on the northern right of way line of College Hill Road; thence along said right of
way line along a curve to the left having a radius of 1480 feet an arc length of 736.72 feet
to a point; thence continuing along said right of way line South 68 degrees 38 minutes 00
seconds West 220.58 feet to a point, being the place and point of BEGINNING.
TOGETHER with any and all right, title and interest which grantor has in and to the
public streets abutting the tracts above described.
UNDER AND SUBJECT, NEVERTHELESS, to easements, restrictions and other
matters, if any, of record or which a physical inspection of the premises would disclose.
BEING the same premises which Fay L. Hildebrandt, Executrix of the Estate of Dale J.
Hildebrandt, deceased, by deed dated October 24, 1986, and recorded in the Cumberland
County Recorder of Deeds Office in Deed Book G-32, page 657; granted and conveyed
unto Central Pennsylvania Business School, Inc.
