Fri WHEREAS, Decedent Josephine Desormeaux died on December 25, 200-5 and her iRstate;~") Ul FAMILY SETTLEMENT AGREEMENT ;~ is being administered in the above Court with Stephen Malloy-Desormeaux as the Executor thereof, and WHEREAS, all debts and costs of administration have been paid, settled, or otherwise discharged, and WHEREAS, pursuant to the Will of Decedent, the sole legatees of this Estate are Stephen Malloy-Desormeaux, Marie Rhoads and David Desormeaux, who are to share equally in the residue of said Estate, and WHEREAS, the said legatees and the Executor desire to complete and consummate the administration of this Estate by the execution of a Family Settlement Agreement, thus obviating the filing of a formal Account, although an informal accounting is nevertheless attached hereto as Exhibit "A", and WHEREAS, pursuant to said accounting, each of the above named legatees are each entitled to one-third of the total distributable amount of$262,794.71; NOW THEREFORE, for and in consideration of $1.00 by each party hereto paid to the other and the receipt by Stephen Malloy-Desormeaux of $87,598.23, Marie Rhoads of $87,598.24 and David Desormeaux of$87,598.24, in full and complete payment and distribution of their respective share legacies, do hereby acknowledge the aforesaid receipt in full satisfaction of all claims against said Estate whether as legatee, creditor or otherwise, and do so hereby release, quit claim, ,discharge and exonerate Stephen Malloy-Desormeaux as Executor of the foregoing Estate from any and all claims and demands of whatsoever kind pertaining to his c . \ , , . administration of this Estate, and do further agree and release said Executor from any duty to file a formal accounting with the Court.
