PETITION FOR INTERPRETATION OF WILL
1. Petitioner, Dierdre M. James, Esquire, is the Executrix of the Estate of the
decedent, Henry J. Grothe. The decedent died on March 8, 2006.
2. Respondents fall into two categories: (1) the issue of the decedent: Henry
J. Grothe, II, Marsha Grothe (deceased), Theodore Grothe, Susan Grothe, Paul Grothe
and Gina Hunking and (2) the "heirs and assigns" of Marsha Grothe: Beverly Sokel,
Randolph Sokel, David Freedman and Steven Keezer.
3. The Executrix and other potential heirs respectfully request an
interpretation of the decedent's will.
4. A true and correct copy of the decedent's will is attached hereto and titled,
"LAST WILL OF HENRY J. GROTHE."
5. The decedent's will is categorized by "Items." Item III bequests the "rest
and remainder" of decedent's estate to "my daughter, Marsha A. Grothe, her heirs and
assigns."
6. Marsha Grothe predeceased the decedent and died on August 3, 2001.

7. The Executrix requests that the Court determine whether the decedent's
gift to Marsha fails, falls beyond Pennsylvania's anti-lapse provision, and into intestacy
or whether the decedent's gift to Marsha goes to Marsha's heirs and assigns.
8. Attorney Robert Grubb, on behalf of his clients, Susan Grothe and Gina
Hunking, claims that the decedent's residual gift to Marsha fails because Marsha
predeceased the decedent. Because Marsha left no issue, Attorney Grubb claims that
Pennsylvania's anti-lapse statute does not save the gift. As a result, Attorney Grubb
claims that the gift falls into intestacy and therefore, must be divided pursuant to
Pennsylvania's intestacy laws. Attorney Grubb cites 20 Pa.C.S.A. Section 2514 (4)
(9)(10) and (11) as authority for his position.
9. Beverly Sokel, Randolph Sokel, David Freedman and Steven Keezer are
the heirs of Marsha A. Grothe. As heirs, they stand to take from the decedent's will if
the court determines that the decedent's gift goes to Marsha's "heirs and assigns."
Beverly Sokel is represented by Silverman, Sclar, Shin & Byrne, PLLC.
WHEREFORE, Petitioner and Respondents respectfully request that the Court
interpret the LAST WILL OF HENRY J. GROTHE.

I, HENRY J. GROTHE of Mechanicsburg, County of Cumberland, Commonwealth
of Pennsylvania, declare this to be my Last Will and revoke any Will previously made by
me.
ITEM I
I direct that all my funeral expenses and all the expenses of my last illness be paid
from my residuary estate as soon as practicable after my death as part of the expense of the
administration of my estate.

I give" devise and bequeath my real estate, whatsoever the same may be and
wheresoever the same may be situate to my son, HENRY J. GROTHE, n, his heirs and
assigns.

I - give and bequeath the rest and remainder of my estate whatsoever the same may be
and wheresoever the same may be situate to my daughter, MARSHA A. GROTHE, her
heirs and assigns.

Executrix of this. my Last Will. If DIERDRE M. JAMES, ESQUIRE. fails to qualify or
ceases to act as Executrix. I appoint my nephew . WAYNE GROTHE. of Southhampton.
New York. Executor of this. my Last Will.
ITEM VI
I direct that my Executor shall not be required to give bond for the faithful
performance of his or her duty in any jurisdiction.
ITEM VII
I purposely make no provisions in this my Last Will for my son. THEODORE
GROTHE. my daughter. SUSAN GROTHE. my son. PAUL GROTHE. and my daughter.
GINA BUNKING. for reasons that I deem just and proper.
