LAST WILL AND TESTAMENT
I, MARGARET G. WHISTLER, of the Borough of Carlisle, Cumberland County,
Pennsylvania, declare this instrument to be my Last Will and Testament, hereby expressly
revoking all Wills and Codicils heretofore made by me.
1. I direct my Executors to pay all of my debts, funeral and administrative expenses as
soon as may be done conveniently after my decease.
2. I authorize and empower my Executors to sell any realty owned by me at my death,
and not specifically devised herein, at either public or private sale, and to ~ve good and
sufficient deeds therefor, in fee simple, as I could do ifliving.
3. I give, devise and bequeath all of my estate of every nature and wherever situate in
three equal shares, as follows:
(a) 1/3 to the two sons of my sister, 'Helen G. McCullough, share and share alike;
(b) 1/3 to my sister, Pauline G. Oiler, and if she is not living at the time of my
death, to her children, share and share alike; and
(c) 1/3 to my brother-in-law, Paul R. Whistler, and if he is not living at the time
of my death, to his children, share and share alike.

4. I nominate and appoint PAVLINE G. OILER and THOMAS A. OILER to be the
Executors of this my Last Will and Testament; they are to serve as such without bond.
5. I hereby suggest that my personal representative retain the services of Irwin &
McKnight as attorneys for the settlement of my estate.

WITNESSETH:
WHEREAS, Mortgagor has executed and delivered to Mortgagee a certain Promissory
Mortgage Note (hereinafter called "Note") of even date herewith, payable to the order of
Mortgagee in the principal sum of One Hundred Forty-eight Thousand Five Hundred and noll 00
($148,500.00) Dollars, lawful money of the United States of America, and has provided therein
for payment of the principal sum, together with interest thereon, in the manner and at the times
therein seL forth and containing other terms and conditions, all of which are specifically
incorporated herein by reference.
NOW, THEREFORE, Mortgagor, in consideration of said debt or principal sum and as
security for the payment of the same and interest as aforesaid, together with all other sums
payable hereunder or under the terms of the Note, does grant and convey unto Mortgagee, her
heirs and assigns, a Mortgage in the amount of One Hundred Forty-eight Thousand Five Hundred
and no/IOO ($148,500.00) on the following property situate ill the Borough of Carlisle,
Cumberland County, Pennsylvania, being more particularly bounded and described as follows:
ALL that certain plot of ground with the improvements thereon erected situate on the
Plan of East Hills, Third Ward of the Borough of Carlisle, Cumberland County, Pennsylvania,
more particularly bounded and described as follows:
BEGINNING at a point on the West side of Hillside Drive as the same appears on the
Plan of East Hills, recorded in the Cumberland County Recorder's Office in Plan Book No.4,
Page 39, which point is 35 feet South of the line dividing Lots Nos. 71 and 72 measured along
the West side of Hillside Drive; thence along the West side of Hillside Drive 103 feet to a point.
which point is 3 feet North of the line dividing Lots Nos. 72 and 73; thence North 76 degrees 58
minutes West by a line parallel to and 3 feet North of said dividing line, 125 feet to a point in the
line dividing Lots Nos. 66 and 73, on said Plan; thence along said last mentioned dividing line

South 13 degrees 2 minutes West, 103 feet to a point at lands now or formerly of Luther Hull and
wife; thence along said lands of Hull and through Lot No. 71 South 76 degrees 58 minutes East,
125 feet to the Place of BEGINNING.
The above described lot of ground being the Northern 35 feet of Lot No. 71, all of Lot
No. 72, and the Southern 3 feet of Lot No. 73 as appears on said Plan.
HA VING thereon erected a dwelling house known and numbered as 76 Hillside Drive.
BEING the same premises' which Margaret G. Whistler, widow, granted and conveyed to
Jason R. Beals and Jamie M. Beals, his wife, by deed dated May ),'fl! ,2005 and recorded in the
Office of the Recorder of Deeds for Cumberland County in Deed Book _, Page ~.
Together with the buildil1-gs and improvements erected, thereon, the appurtenances
thereunto belonging and the reversions, remainders, rents issues and profits thereof.
TO HAVE AND TO HOLD the same unto Mortgagee, her heirs and assigns, forever.
PROVIDED, however, that if Mortgagor shall pay to Mortgagee the aforesaid debts or
principal sum, and all other sums payable by the same to Mortgagee hereunder and under the
terms of the Note, together with interes~ thereon, and shall keep and perform each of'the other
covenants, conditions and agreements of the Note and as hereinafter set forth, then this Mortgage
and the estate hereby granted and conveyed shall become void.
This Mortgage is executed and delivered subject to the following covenants, conditions
and agreements:
(1) From time to time until said debts and interest are fully paid, Mortgagor shall: (a)
pay and discharge, when and as the same shall become due and payable, all taxes, assessments,
sewer and water rents and all other charges and claims assessed or levied from time to time by
any lawful authority upon any part of the mortgaged premises and which shall or might have
priority in lien or payment to the debts secured hereby, (b) pay all ground rents reserved from the
mortgaged premises and pay and discharge all mechanics' liens which may be filed against said
premises and which shall or might have priority in lien or payment of the debts secured hereby,
(c) pay and discharge any documentary stamp or other tax, including interest and penalties
thereon, if any now or hereafter becoming payable on the Note evidencing the debt secured
hereby, (d) promptly submit to Mortgagee evidence of the due and punctual payment of all the
foregoing charges upon request.
(2) In the event Mortgagor neglects or refuses to pay the charges mentioned at (1)
above, Mortgagee may do so, add the cost thereof to the principal debt secured hereby, and
collect the same as part of said principal debt.

(3) Mortgagor covenants and agrees not to create, nor permit to accrue, upon all or any
part of the mortgaged premises any debts, liens or charges which would be prior to, or on a parity
with, the lien of this Mortgage.
(4) In case default be made for the space of fifteen (15) days after written notice thereof
in the payment of any installment of principal or interest pursuant to the terms of the Note, or in
the performance by Mortgagor of any of the other obligations under the Note or this Mortgage.
the entire unpaid balance of said, principal sum, together with unpaid interest thereon, shall at the
option of Mortgagee without notice thereof to Mortgagor become immediately due and payable,
and foreclosure proceedings may be brought forthwith on this Mortgage and prosecuted to
judgment, execution and sale for the collection of the same, together with costs of suit and an
attorney's commission for collectlon of five (5%) percent, of the total indebtedness. Mortgagor
hereby forever waives and releases all errors in said proceedings, waives stay of execution, the
right of inquisition and extension of time of payment, agrees to condemnation of any property
levied upon by virtue of any such execution, and waives all exemption from levy and sale of any
property that now is or hereafter'~ay be exempted by law.
(5) In the event of any conveyance or assumption of said mortgaged premises, the
Mortgagor will forthwith notify t~e Mortgagee thereof, and, at the option of the Mortgagee,
this Mortgage shall thereupon b~come due and payable in full upon demand.
(6) The covenants, conditions and agreements contained in this Mortgage shall bind, and
the benefits thereof shall inure to the respective parties hereto and their respective heirs,
executors, administrators, successors and assigns, and if this Mortgage is executed by more than
one person or other legal entity, the undertakings and liability of each shall be joint and several.
(7) The Note secured hereby shall evidence and this Mortgage shall cover and be security
for any future advances or loans that may be made by Mortgagee to Mortgagor at any time or
times hereafter and intended by Mortgagor and Mortgagee to be so evidenced and secured, and
such loans and advances shall be added to the principal debt.
