THIS AGREEMENT made the o~':/~°a day of August, 2001, by and
between W. LEE ROLAND, BUILDER, of 101 Windrush Lane, Mechanicsburg, PA
17055, hereinafter referred to as Contractor, AND DAVID R. EHRHART and DEBRA
A. EHRHART, husband and wife, of 654 Billet Drive, Mechanicsburg, PA 17055,
hereinafter referred to as Owner, whereby the former undertook and agreed to erect and
construct a single-family residential dwelling on that certain lot of ground situate on
Lynn Brook Way in Upper Allen Township, Cumberland County, Pennsylvania, being
Lot No. 20 of Phase II, Lindenwood.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00) Dollar to him in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the fight to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them and agree that this instrument, waiving
the fight of lien, shall be an independent covenant.

be signed by its proper corporate officers and its corporate seal to be affixed hereto, the
day and year above written.

ALL that certain lot or piece of ground situate in Upper Allen Township,
Cumberland C~u~ty, Pennsylvania, more particularly bounded and described
as follows:
Beginning at a point on the southern right-of-way of Lynnbrook Way of the
Final Subdivision Plan of Lindenwood,
Phase II prepared by Dawood
Engineering, Inc., dated December 1, 1998 and latest revision dated March
25, 1999, said point being located at the dividing line between Phase II
and Phase III of said Final Subdivision Plan;
Thence along the southern right-of-way of Lynnbrook Way the following
three (3) courses and distances:
(1) By a curve to the right having a radius of 250 00 feet an arc length
of 14.49 feet with a chord bearing of North ~2 degrees 58 minutes 51
seconds East and a chord distance of 14.49 feet to a point on the
southern right-of-way of Lynnbrook Way;
(2) By a curve to the right having a radius of 575.00 feet an arc length
of 95.82 feet with a chord bearing of North 49 degrees 24 minutes 55
seconds East and a chord distance of 95.71 feet to a point on the same;
(3) North 54 degrees 11 minutes 22 seconds East a distance of 57.28 feet
to a point on the same at the westernmost corner of Lot No. 19 of the
above referenced Final Subdivision Plan;
Thence along said Lot No. 19 South 35 degrees 48 minutes 38 seconds East
a distance of 168.88 feet to a point on the northwestern line of Lot No.
25 of the above referenced Final Subdivision Plan;
Thence along said Lot No. 25 and continuing along Residual lands of Real
Source Development South 44 degrees 57 minutes 50 seconds West a distance
of 139.69 feet to a point at the dividing line of Phase II and Phase III
of the above referenced Final Subdivision Plan;
Thence along said dividing line North 45 degrees 02 minutes 10 seconds
West a distance of 180.83 feet to a point on the southern right-of-way
line of Lynnbrook Way at the dividing line of Phase II and Phase III of
the above referenced Final Subdivision Plan, the place of Beginning.
Containing 0.62 acres, more or less.
BEING Lot No. 20 of Lindenwood, A Planned Community - Phase II recorded
in Plan Book 78, Page 121.
BEING Parcel 42-27-1890-218.
