HomeMy WebLinkAbout02-2286STIPULATION AGAINST LIENS THIS AGREEMENT made the ~rJ day of ~ , 2002, by and between J. W. MUMPER CONSTRUCTION, INC., of One Bull Run Court, Mechanicsburg, PA 17050, hereinafter referred to as Contractor, ~ DAVID M. KRICK and PEGGY JO KRICK, husband and wife, of 4255 Ascot Circle, Allentown, PA 18103, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single-family residential dwelling on that certain lot of ground situate on South View Drive, in Upper Allen Township, Curaberland County, Pennsylvania, being Lot No. 21, Phase IV, Meadowview Estates, Section II, said plan being recorded in Plan Book 78, Page 147. Being part of the same premises which John M. Knaub by Deed dated June 24, 1996 and recorded June 26, 1996 in the Cumberland County Recorder of Deeds Office in Deed Book 141, Page 644, granted and conveyed unto Cindy L. Arnold and Mark A. Knaub, a general partnership. The said Cindy L. Arnold is now known as Cindy L. Arnold-Steele. Also being the same premises which Cindy L. Arnold-Steele and Mark A. Knaub, a general partnership, by Deed dated February 8, 2002 and recorded in the Cumberland County Recorder of Deeds Office in Deed Book 250, Page 2008, granted and conveyed unto DAVID M. KRICK and PEGGY JO KRICK, husband and wife. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1.00) to have, against instrument, covenant. Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right file, and maintain any mechanic's liens or claims the said buildings or any of them and agree that this waiving the right of lien, shall be an independent WITNESS our hands and seals, or if a corporation, it has caused these presents to be signed by its proper corporate officers and its corporate year above written. KRICK and PEGGY JO KRICK, known to me (or satisfactorily proven) to be the persons whose names are subscribed to the within instrument and acknowledged that they executed the same for the purposes therein contained. MUMPER CONSTRUCTION, INC., a corporation, and that he as such officer, being authorized to do so, executed the foregoing statement for the purposes therein contained by signing the name of the corporation by himself as said officer.
