LARRY V. NEIDLINGER of 595 Greason Road, Carlisle, PA 17013, hereinafter
referred to as Contractor,
And
ROBERT J. YINGER and SH]RELY A. YINGER, HIS WIFE, of 7 Village Lane,
Newville, PA 17241, hereinafter referred to as Owners,
Whereby the Contractor undertook and agreed to erect and construct a mobile
home park on that certain lot of vacant grotmd located on Potato Road in Upper
Frankford Township, as is described on the Final Subdivision Plan prepared for
Larry .V. and Mary Jo Neidlinger and recorded in the Recorder of Deeds Office
in and for Cumberland Cotmty, Pennsylvania, in Plan Book 62, page 50. A legal
description is attached as Exhibit A.
NOW, THEREFORE, this Agreement witnesseth: That the said contractor, for
and in consideration of the sum of One ($1.00) Dollar to him in hand paid by
Owners, the receipt whereof is hereby acknowledged and the further
consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and aH parties acting through or under them, covenant and agree
that no mechanic's Hens or claims shall be filed or maintained y them or any of
them against the said improvements and the lot of ground appurtenant thereto
for or on account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and
construction of the said improvements on the lot above described and the said
contractor, for themselves, their sub-contractors and others under them hereby
expressly waives and relinquishes the right of have, file and maintain any
mechanic's liens or claims against the said improvements or any of them and
agree that this instrument, waiving the right of Hen, shah be an independent
covenant.
