Co is an insurance company licensed and authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its principal places of business the above captioned address. 2. The Plaintiff Kevin Dykes is an adult individual residing at the above captioned address. 3. The Defendant David Lee Richards is an adult individual residing at the above captioned address. 4. On April 30, 2006 Plaintiff Liberty Mutual Insurance Company insured Kevin Dykes with an automobile policy, policy number A06288130119-10-S, said policy covering A 2000 Mazda. Protege. 5. On or about April 30, 2006 the Defendant Richards broke into an apartment leased by Aaron Dykes and removed the vehicle keys to the Mazda Protege without permission. While operating the Plaintiffs vehicle without permission the Defendant David Lee Richards struck a house on Fort Street and North Washington Avenue in Shippensburg Township, PA. 6. The negligence of the Defendant consisted of: a. Driving under the influence of alcohol; b. Failing to warn Plaintiff of danger; C. Failing to make proper observations; d. Failing to use due care; e. Driving recklessly; f. Other such negligence developed through discovery and trial of this matter; 7. The aforesaid accident occurred solely as the result of the negligence of the Defendant. 8. As a result of the aforesaid one vehicle automobile accident, Plaintiff Liberty Mutual Ins. Co. settled the collision claim of Kevin Dykes in the amount of $6,356.60, (said figure includes Kevin Dykes first party deductible) representing fair and reasonable reimbursement for the damages sustained. 9. Pursuant to the aforesaid policy of insurance, Plaintiff Liberty Mutual Ins. Co. is subrogated to Kevin Dykes for this loss.
