STIPULA TION AGAINST LIENS
WHEREAS, CHARLES R. LEX and LEASE D. LEX, husband and wife, are about to execute
contemporaneously herewith, a contract with CHARLES R. LEX and LEASE D. LEX, husband and wife,
for the erection of a single-family dwelling upon ALL THAT CERTAIN TRACT ofland, situate in the in
the Township of Dickinson, County of Cumberland and Commonwealth of Pennsylvania, being more
particularly bounded and described as follows, to wit:
BEGINNING at a steel pin set on the eastern side ofa private right-of-way shown on the hereinafter mentioned
plan of subdivision at the common point of adjoiner of the within described tract, Parcel E on the hereinafter mentioned
plan, and said right-of-way; thence departing from the right-of-way and extending along Parcel E and other lands, South
sixty (60) degrees thirty (30) minutes twenty (20) seconds West, for a distance of three hundred fifty-seven and fifty-six
hundredths (357.56) feet to an existing iron pipe at lands now or fortherly of Kenneth E. Ream; thence continuing South
sixty (60) degrees twenty-eight (28) minutes thirty-five (35) seconds East, for a distance of two hundred four and seven
hundredths (204.07) feet to a point marked by a pipe at lands now or formerly of Ralph E. Rice Jr.; thence extending
along said lands, South forty-one (41) degrees thirty-seven (37) minutes twelve (12) seconds West, for a distance of
fifteen hundred eighty-four and ninety-nine hundredths (1584.99) feet to an existing rebar on the eastern side of a private
right-of-way which is part of Parcel A on the hereinafter mentioned plan of subdivision; thence along the eastern side
of said right-of-way the following six courses and distances: North twenty (20) degrees thirty-eight (38) minutes eleven
(11) seconds West, for a distance of fifty-five and fifty-three hundredths (55.53) feet to a point thence by an arc or curve
to the right having a radius offorty (40) feet, a chord length of thirty-five and eight hundredths (35.08) feet on a bearing
North five (05) degrees twenty-two (22) minutes twenty-two (22) seconds West, for an arc length of thirty-six and thirty-
two hundredths (36.32) feet to a point; thence continuing by an arc or curve to the left having a radius of ninety (90) feet,
a chord length of seventy-eight and ninety-four hundredths (78.94) feet on a bearing North five (05) degrees twenty-two
(22) minutes twenty-two (22) seconds East, for an arc length of eighty-one and seventy-two hundredths (81.72) feet to
a point; thence continuing North twenty (20) degrees thirty-eight (38) minutes eighteen (18) seconds West, for a distance
of one hundred sixty-nine and seventy hundredths (169.70) feet to a point; thence by an arc or curve to the right having
a radius offorty (40) feet, a chord length ofthirty-three and fifty hundredths (33.50) feet on a bearing North four (04)
degrees six (06) minutes fifty-four (54) seconds East, for an arc length ofthirty-four and fifty-six hundredths (34.56) feet
to a point; thence continuing in and along said roadway, North twenty-eight (28) degrees fifty-two (52) minutes six (06)
seconds East, for a distance of twelve hundred eighty-seven and thirteen hundredths (1287.13) feet to a point marked
by a pin at Parcel E, said point marking the place of BEGINNING.

Known as High Fields, prepared for Harry H. Fox Jr., by Shelly & Witter, Inc., P.L.S., dated May 2002, and recorded
in the Office ofthe Recorder of Deeds in and for Cumberland County, Pennsylvania, on January 3, 2003, in Plan Book
86, at page 82.

TOGETHER WITH the rights of ingress, egress, and regress over and along a fifteen (15) foot wide private
easement which extends from the cartway of Myerstown Road (T-524) to the hereinbefore mentioned cul-de-sac.
BEING THE SAME PREMISES which Harry H. Fox, Jr. And Ann G. Fox, husband and
wife, by Deed dated July 14,2005, and recorded July 18,2005 in Cumberland County, Pennsylvania
Record Book 269, at Page 4751, granted and conveyed unto Charles R. Lex and Lease D. Lex,
husband and wife.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the parties, as part of
said contract, and for consideration therein set forth, that neither the undersigned Contractor, nor any
subcontractor or materialman, nor any other person furnishing labor or materials to the Contractor under the
subject contract shall file a Hen for work performed, or materials furnished ta the building or any part thereof.
The General Contractor hereby agrees to waive any defects in the filing and indexing of this lien
waiver in the Office ofthe Prothonotary where it is to be filed pursuant to Section 1402 of the Mechanics'
Lien Law of 1963, and agrees that it will not contest the validity of the lien waiver based upon any such
defect, and hereby agrees to this waiver of defects on behalf of any of the subcontractors, materialmen, or
suppliers that may provide any labor or material under the General Contractor's agreement with the Owner
and who, but for the same waiver, would be entitled to assert mechanics' liens against the Owner's property
under the Mechanics' Liens Law of 1963.
The General Contractor also hereby agrees to provide actual notice of the lien waiver to all
subcontractors, materialmen, and suppliers prior to the providing of any labor or material by them to the
project, and will further provide for a written acknowledgment by each of these persons ofthe lien waiver
prior to providing any labor or material to the project.
IN WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals the day
and year aforesaid.
