U ZCOMPLAINT FOR A DECLARATORY JUDGMENT 1. Nicholas J. Shears ("Mr. Shears") is an adult individual who resides at 6135 Run Cross Lane, Enola, Pennsylvania 17025. 2. Quest Diagnostics, Incorporated ("Quest") is a corporate entity authorized to conduct business in Pennsylvania with an office address at 900 Business Center Drive, Horsham, Pennsylvania 19041. 3. Quest routinely provides laboratory services for physicians, including laboratory services for Keystone Urology, P.C. located at 645 North 12`h Street, Suite 300, Lemoyne, Cumberland County, Pennsylvania 17043. 4. On or about February 23, 2005, Mr. Shears presented to Christopher Moyer, M.D. of Keystone Urology for a biopsy of his prostate gland. 5. On March 7, 2005, Quest issued a report, which, inter alia, diagnosed adenocarcinoma, Gleason 3 + 3 (6) in a single microfocus ("Quest report"). A true and correct copy of the laboratory report is attached hereto as Exhibit "A". 6. Based upon the biopsy result, Mr. Shears presented to Christian P. Pavlovich, M.D. at Johns Hopkins Medical Center for treatment. 7. Dr. Pavlovich recommended and Mr. Shears agreed to surgery to remove the prostate gland based upon the results of the Quest report. 8. Surgery was performed by Dr. Pavlovich on June 29, 2005 for removal of Mr. Shears' prostate gland. 9. The prostate gland was submitted for pathology evaluation at Johns Hopkins. Evaluation of the actual prostate gland failed to reveal any cancer cells in the prostate gland removed from Mr. Shears. 10. It is believed and therefore averred that Dr. Moyer obtained six core biopsies and submitted the same to Quest. The specimens were labeled by Quest as HT06-17265A through HT06-17265F. 11. It is believed and therefore averred that only one slide from HT06-17265B purportedly showed cancer cells. 12. Based upon the negative pathology report of the prostate gland following the prostatectomy, Mr. Shears does not know whether he actually had cancer of the prostate gland or the pathology slide in question was contaminated with cancer cells from another individual. 13. Technology exists to perform DNA testing on the cancer cells on the biopsy slide in question to determine whether the cancer cells are from Mr. Shears. 14. Mr. Shears has on several occasions, requested the slide in question so that DNA testing can be performed to definitively determine whether the cancer cells on the slide are Mr. Shears' cells. 15. Mr. Shears is willing to allow Quest to have a representative present during the testing. Also, Mr. Shears is willing to allow Quest to photograph or otherwise document the slide both before, during and after the DNA testing. 16. Despite the foregoing, Quest has refused to deliver the slide in question to Mr. Shears. 17. Mr. Shears is entitled to the slide in question to have DNA testing performed. 18. Without DNA testing of the slide, Mr. Shears cannot determine if he actually had cancer, whether the prostatectomy was necessary and whether he must continue to endure the stigma and concerns of having had cancer. 19. It is believed and therefore averred that Quest knows that the only way for Mr. Shears to determine whether the cancer cells are Mr. Shears' or contaminated cells from another individual is to perform DNA testing. 20. Without DNA testing, Quest is preventing Mr. Shears from completing evaluation of his condition and evaluation of a potential claim against, inter alia, Quest. 21. Mr. Shears requests a declaratory judgment in his favor and against Quest that he is entitled to the slide of his tissue for DNA testing. WHEREFORE, Nicholas J. Jonathan I. Epstein, M.D. ("Dr. Epstein") was at all times relevant hereto a licensed professional and a physician practicing medicine at 401 North Broadway, Baltimore, MD, 21231-2410. 9. Kathryn Marie Johnson, M.D. ("Dr. Johnson") was at all times relevant hereto a licensed professional and a physician practicing medicine at 401 North Broadway, Baltimore, MD, 21231-2410. 10. Kim Studeman, M.D. ("Dr. Studeman") was at all times relevant hereto a licensed professional and a physician practicing medicine at 401 North Broadway, Baltimore, MD, 21231-2410. 11. Johns Hopkins Hospital and Health System ("Johns Hopkins") is a hospital and health system, which at all times relevant hereto conducted business at 401 North Broadway, Baltimore, MD, 21231-2410. 12. On or about February 23, 2005, Mr. Shears presented to Dr. Moyer at Keystone Urology, P.C. and/or Urology of Central Pennsylvania, Inc. for a biopsy of his prostate gland. 13. Dr. Moyer transmitted the specimens obtained during Mr. Shears' biopsy to Quest for laboratory analysis and diagnosis. 14. By information and belief, Mr. Shears' specimens were read and interpreted by Dr. Peterson at Quest. 15. On March 7, 2005, Quest issued a report, which, inter alia, diagnosed adenocarcinoma, Gleason 3 + 3 (6) in a single microfocus ("Quest report"). 16. Based upon the biopsy result, Mr. Shears presented to Dr. Pavlovich at Johns Hopkins for treatment. 17. On or about April 12, 2005, Dr. Johnson, the resident pathologist at Johns Hopkins received Mr. Shears' biopsy specimens from Quest. 18. On or about, April 13, 2005, Dr. Epstein provided a second opinion with regard to Mr. Shears' biopsy specimens, which confirmed the findings of the Quest report. 19. Dr. Pavlovich recommended Mr. Shears undergo surgery to remove the prostate gland based upon the results of the Quest report and the second opinion of Dr. Epstein. 20. On or about June 29, 2005, Dr. Pavlovich performed surgery to remove Mr. Shears' prostate gland. 21. The prostate gland was submitted to Dr. Studeman for pathology evaluation. 22. Evaluation ofthe actual prostate gland failed to reveal any cancer cells in the prostate gland removed from Mr. Shears. 23. It is believed and therefore averred that Dr. Moyer obtained six core biopsies and submitted the same to Quest. The specimens were labeled by Quest as HT06-17265A through HT06-17265F. 24. It is believed and therefore averred that only one slide from HT06-17265B purportedly showed cancer cells. 25. Based upon the negative pathology report of the prostate gland following the prostatectomy, Mr. Shears does not know whether he actually had cancer of the prostate gland or the pathology slide in question was contaminated with cancer cells from another individual. 26. Technology exists to perform DNA testing on the cancer cells on the biopsy slide in question to determine whether the cancer cells are from Mr. Shears. 27. Mr. Shears has on several occasions, requested the slide in question so that DNA testing can be performed to definitively determine whether the cancer cells on the slide are Mr. Shears' cells. 28. Mr. Shears is willing to allow all Defendants to have representatives present during the testing. Also, Mr. Shears is willing to allow all Defendants to photograph or otherwise document the slide both before, during, and after the DNA testing. 29. Despite the foregoing, the Defendants have refused to deliver the slide in question to Mr. Shears. 30. Mr. Shears is entitled to the slide in question to have DNA testing performed. 31. Without DNA testing of the slide, Mr. Shears cannot determine if he actually had cancer, whether the prostatectomy was necessary and whether he must continue to endure the stigma and concerns of having had cancer. 32. Plaintiff acknowledges that DNA testing of the biopsy slide will result in the slide being destroyed in the testing process and thereby unavailable for pathological review; 7. Plaintiffs agree that they will not seek spoliation sanctions or an adverse inference against any of the Defendants based on destruction of the slide tested; 8. Plaintiff agrees that all Defendants will be notified twenty-one (21) days in advance of DNA testing and all Defendants will be permitted to have a representative observe the testing if they so choose; 9.
