Dear Judge Hoffer:
I understand that there is a hearing before Your Honor scheduled for Monday, October 4, 2004,
regarding a Petition of Elizabeth M. Barth to Revoke Letters of Administration and a request that
she be appointed Administrarix of the above-named Estate. I represent the interests of
MaryEllen Brouse and Anthony Jerome Gross, siblings of the Decedent.
Mrs. Brouse and Mr. Gross are in full agreement that Letters of Administration should be issued
to their brother, Brian J. Gross, and not to Elizabeth Barth. Ms. Barth was never married to the
decedent, and is unlikely able to prove that she was the Common-Law spouse of the Decedent.
My clients therefore wish to advise that Mr. Gross should be issued Letters of Administration,
and that their interests will be protected by granting such.
