LAST WILL AND TESTAMENT
OF
MARY R. DONAGHY
I, MARY R. DONAGHY, of Mechanicsburg, Cumberland
County, Pennsylvania, make, publish and declare this as and for
my Last Will and Testament, hereby revoking all other wills and
Codicils heretofore made by me.
FIRST: I give and bequeath my six-prong Solitaire
Ring, approximately .88 karats and my Beaver Coat to my niece,
ELAINE M. HERALD.
SECOND: I give and bequeath my three-diamond Ring (one
large diamond and two small diamonds) to my niece, KATHLEEN D.
BRONSTEIN.
THIRD: I give and bequeath my five-diamond Wedding
Band to my niece, NANCY DOUGHERTY HARVEN.
FOURTH: I give and bequeath my Diamond Heart Pendant
to my sister-in-law, ARLENE DOUGHERTY.
FIFTH: I give and bequeath my Mink Coat to my sister-
in-law, GWENDOLYN DOUGHERTY.
SIXTH: I give and bequeath my Emerald Ring and my
Crystal to my sister-in-law, FRill~CES DOuGHERTY.
SEVENTH: I give and bequeath the sum of One Thousand
and No/I00 ($1,000.00) Dollars to THE SOCIETY FOR THE PROPAGATION
OF THE FAITH, of Union Deposit Road, Harrisburg, Pennsylvania,
for the purpose of the saying of Gregorian Masses for the repose
of my soul.
EIGHTH: Should any of the individuals named In the
FIRST through SIXTH Clauses hereinabove predecease me, I direct
that the items bequeathed to them be and become a part of my
residuary estate to be distributed as set forth hereinbelow.
NINTH: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
including any property over which I hold power of appointment and
together with any insurance policies thereon, as follows:
(A) Twenty-five percent (25%) thereof to my brother, JOHN J.
DOUGHERTY, provided that should he predecease me, then to his
issue per stirpes by representation, and if there be a failure of
same, then I give and bequeath his share to my surviving brothers
as provided herein.
(B) Twenty-five percent (25%) thereof to my brother, AUSTIN
C. DOUGHERTY, provided that should he predecease ruB, then to his
issue per stirpes by representation, and if there be a failure of
same, then I give and bequeath his share to my surviving brothers
as provided herein.
(C) Twenty-five percent (25%) thereof to my brother,
LAWRENCE J. DOUGHERTY, SR., provided that should he predecease
me, then to his issue per stirpes by representation, and if there
be a failure of same, then I give and bequeath his share to my
surviving brothers as provided herein.
(D) Twenty-five percent (25%) thereof, In equal shares, to
the children of my deceased brother, CHARLES L. DOUGHERTY, said
children being JOSEPH DOUGHERTY, THOMAS DOUGHERTY" and KATHLEEN
BRONSTEIN, provided that should any of these individuals
predecease me, I give and bequeath such individual's share to his
or her issue per stirpes by representation, and if there be a
failure of same, then I give and bequeath such deceased individ-
ual's share to the surviving children of CHARLES L. DOUGHERTY.
TENTH: In addition to all powers granted to them by
law and by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all proper-
ty, exercisable without court approval and effective until actual
distribution of all property:
?
(A) To sell at public or private sale, or to lease,
for any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such terms (including credit, with or without security) or
conditions as are deemed proper. This includes the power to give
legally sufficient instruments for transfer of the property and
to receive the proceeds of any disposition of it.
(B) To compromise any claim or controversy and to
abandon any property which is of little or no value.
(C) To invest in all forms of property, including
stocks, common trust funds and mortgage investment funds, without
restriction to investments authorized for pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(D) To exercise any option, right or privilege granted
In insurance policies or in other investments.
(E) To exercise any election or privilege glven by the
Federal and other tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(F) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.
(G) To select a mode of pa}nnent under any qualified
retirement plan (pension plan, profit sharing plan, employee
stock ownership plan, or any other type of qualified plan) to the
extent the plan or the law permits them to do so, and to exerciSE
any other rights which they may have under the plan, in whatever
manner they consider advisable.
ELEVENTH: I direct that all inheritance, estate,
transfer, succeSSlon and death taxes, of any kind whatsoever,
which may be payable by reason of my death, whether or not with

respect to property passing under this Will, shall be paid out of
the principal of my residuary estate.
TWELFTH: I nominate and appoint my brothers, AUSTIN C.
DOUGHERTY and LAWRENCE J. DOUGHERTY, SR., Co-Executors of this,
my Last Will and Testament. In the event of the death, resigna-
tion or inability to serve for any reason whatsoever of the said
AUSTIN C. DOUGHERTY or LAWRENCE J. DOUGHERTY, SR., I nominate and
appoint my niece, ELAINE M. HERALD, Co-Executor of this, my Last
Will and Testament. I direct that my Co-Executors, as the case
may be, shall not be required to post security or a bond for the
performance of their duties in any jurisdiction.
