WHEREAS, Carlisle Area Health & Wellness Foundation of 274 Wilson Street, Carlisle,
Pennsylvania 17013/ is about to enter into a contract with Terra Technical Services, LLC, of
Downingtown, Pennsylvania, for the demolition and site redevelopment of the property known as
the Carlisle Hospital at 246 Parker Street, Borough of Carlisle, Cumberland County, Pennsylvania.
NOW, October 12/ 2006/ at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Carlisle Area Health & Wellness
Foundation to the said Terra Technical Services, LLC to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with Terra
Technical Services, LLC, and the further consideration of One Dollar to Terra Technical Services, LLC,
paid by Carlisle Area Health & Wellness Foundation, it is agreed that no lien shall be filed against
the building or property by the contractor, nor any subcontractor, nor by any of the material men or
workmen nor any other person for any labor, or materials purchased, or extra labor or materials
purchased for the completion of said building, the right to file such liens being expressly waived.
WITNESS our hand and seals the day and year aforesaid.
