WHEREAS, Jack and Delores Heinold, of 17 Laurel Drive, Mechanicsburg, PA, is about
to execute contemporaneously herewith, a contract with Pollard & Co., Inc., Contractor, of P.O.
Box 66, Dillshurg, PA 17019, for the erection of a two story residential building upon a lot of
land situate in Upper Allen Township, Cumberland County, more fully described in attached
Exhibit "A".
NOW, May 21, 2002, at the time and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to
commence work on the said building, or purchase materials for the same in consideration of the
making of the said contract with Owner and the further consideration of One Dollar to
Comractor paid by Owner, it is agreed that no lien shall be filed against the building by the
Contra~or, or any sub-coatractor, nor by any of the material men or workers or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.

ALL THAT CERTAIN piece or parcel of land situated in Upper Allen Township, Cumberland County,
Commonwealth of Pennsylvania, more particularly bounded and fully described as follows:
BEGINNING at a point located on the eastern right-of-way line of Lobach Drive, Twenty-five Feet (25')
from the centedine of the same and a front corner of lot No. 40.
THENCE along said right-of-way, North Twenty-four Degrees Thirty Minutes Forty-nine Seconds West a
distance of Forty-one and Twenty Hundredths Feet (N 24°30'49" W - 41.20') to a point on the same.
THENCE along the same with a curve to the right, having a Radius of One Hundred Fifteen and Zero
Hundredths Feet, an Arc length of Seventy4wo and Thirty4ive Hundredths Feet, a chord bearing of North
Six Degrees Twenty-nine Minutes Twenty-eight Seconds West, a chord distance of Seventy-one and
Sixteen Hundredths Feet (R=115.00', A=72.35', N 6°29'28" W - 71.16') to a point on the same and a front
corner of lot No. 42.
THENCE leaving said right-of-way and along the property line of said lot, South Eighty-one Degrees Fifty-
six Minutes Seventeen Seconds East a distance of One Hundred Fifty-four and Thirty-three Hundredths
Feet (S 81°56'17" E - 154.33') to a point on the same, a rear corner of said lot and a rear corner of lots
No.12 and No. 13 of Phase 1.
THENCE along the rear property line of lot No. 13, South Twenty-one Degrees Fifty-one Minutes Forty-
two Seconds West a distance of Thirty-seven and Forty-seven Hundredths Feet (S 21°51 '42" W - 37.47')
to a point on the same and a rear corner of lots No. 13 and No. 40,
THENCE along the property line of lot No. 40, South Sixty-five Degrees Twenty-nine Minutes Eleven
Seconds West a distance of One Hundred Twenty-five and Zero Hundredths Feet (S 65°29'11" W -
125.00') to a point on the same, a front corner of said lot, on the eastern right-of-way line of Lobach Drive
and the Point of Beginning.
