CIVIL ACTION - EQUITY PETITION FOR STAY OF EVICTION AND EMERGENCY RELIEF AND NOW comes Defendants, Arthur and Deborah Davis, by and through their counsel, Ira H. Weinstock, P.C., and files this PETITION FOR STAY OF EVICTION AND EMERGENCY RELIEF, and aver the following: 1. On October 3, 2006, a Hearing on a Complaint for Recovery of Real Property was conducted before Magisterial District Judge Harold E. Bender. 2. No Decision was issued at the immediate conclusion of the Hearing. 3. On October 24, 2006, Defendants forwarded to their counsel an Order for Possession, a copy of which is attached hereto and marked Exhibit "A". 4. At the time of the receipt of the Order of Possession, neither Defendants nor Defendants' counsel had received a decision from the District Justice regarding Plaintiff's Landlord/Tenant Complaint, a copy of which is attached hereto and marked Exhibit "B". 5. Upon receipt of the Order for Possession, Attorney Jeffrey Schott contacted the District Justice's office to inquire as to whether a decision had been entered on the Landlord/Tenant complaint. He was informed that a decision had been entered. 6. Attorney Schott requested that the District Justice's Office forward a copy of the decision, which was faxed to Attorney Schott on October 24, 2006. 7. On or about October 24, 2006, Defendants filed an Appeal of the Decision of the District Justice, which was docketed on October 25, 2006. 8. On or about October 25, 2006, Defendants received a notice of eviction effective November 2, 2006. 9. Defendants respectfully request that this Honorable Court Stay the Eviction of Defendants and any Order for Possession pending a hearing of Defendants' Appeal on the merits. 10. There is no rent overdue to Plaintiff and, therefore, Plaintiff will not be substantially prejudiced by staying the eviction pending Defendants' appeal.
