George Reed and Jennifer Reed are husband and wife and reside at 13781 Eaglesnest Bay Drive, Corpus Christi, Texas 78418. 2. C. Anthony Ulen and Theresa Ulen are husband and wife and it is believed and therefore averred that they reside at 1415 Cumberland Street, Harrisburg, Dauphin County, Pennsylvania 17103. 3. Plaintiffs are the owners of certain real property located at 515 Meadowcroft Circle, Mechanicsburg, Pennsylvania 17055, on which is located a three bedroom townhouse. 4. On July 25, 2005, Plaintiffs entered into a written lease agreement with the Defendants whereby the Defendants were going to rent Plaintiffs' property at 515 Meadowcroft Circle, Mechanicsburg, Pennsylvania 17055 (a copy of the Lease is attached hereto and marked Plaintiffs' Exhibit 1). 5. Under the terms of the Lease, rent was One Thousand Three Hundred Ninety-Five Dollars ($1,395.00) per month. 6. The Defendants failed to pay rent for the months of June 2006 and July 2006. 7. The Defendants refused to vacate the property at the expiration of the Lease, said Lease having expired on August 1, 2006, and did not vacate the property until compelled to do so by court order on November 2, 2006. 8. The Defendants did not pay any rent for the months of August 2006, September 2006, and October 2006, although they continued to reside at the leasehold premises. 9. The total rent due and owing from June 2006 through October 2006 is $6,975.00. 10. The Lease Agreement also provide for late payments in the amount of Fifty Dollars ($50.00) for any rent not paid by the fifth (5`h) day after it is due. 11. The total late fee charges is $250.00. 12. The Defendants damaged the leasehold premises as follows: A. Stair railing between kitchen and living room is loose and pulled out of the wall; B. There is a crack in the wood of the kitchen island at the bottom side of the island closest to the breakfast area; C. There is a hole in the backside of the door in the family room/den; D. There was a hole in the wall in the family room/den which someone tried to patch and fix; E. There is candle wax on the window sills, window, blinds and carpet in the family room/den; F. There is a carpet tear at the bottom of the stairs near the kitchen; and 13. The costs of repairs to the aforementioned items was $245.00. 14. The carpets were cleaned at a cost of $220.00. 15. The entire leasehold premises had to be cleaned at a cost of $430.00. 16. Due to the need to forcefully evict the Defendants, Plaintiffs incurred the cost of $90.00 to replace the locks. WHEREFORE, Plaintiffs, GEORGE REED and JENNIFER REED, pray that this Honorable Court will enter judgment in favor of the Plaintiffs and against the Defendants in the amount of $8,210.00 plus costs. Antony Ulen (hereinafter referred to as "Tenant") and Theresa Ulen ("Tenant") agrees to lease from George and Jennifer Reed (hereinafter referred to as "Landlord") the premises situated in Cumberland County, Pennsylvania and located at 515 Meadowcroft Circle, Mechanicsburg, PA 17055 ("the premises"), upon the following terms and conditions: Term: The term of this Lease is for one year, commencing on the 25th day of July, 2005 and expiring on the 1 st day of August, 2006, unless renewed or extended pursuant to the terms herein. Payment of Rent: Monthly rent is Thirteen Hundred and Ninty Five Dollars ($1395), payable in advance on the first day of each calendar month. Rent shall be made payable to George Reed and mailed or delivered to the following address: 1771 Kendall Drive, Mechanicsburg, PA 17055. Rat y e e ivere y 0 Returned Check and Stop Payment: In each instance that a check offered by Tenant to Landlord for any amount due under this Agreement or in payment of rent is returned for lack of sufficient funds, a "stop payment" or any other reason, a service charge of $50 will be assessed. Late Charges: If Tenant fails to pay the rent in full before the end of the 5th day after it's due, Tenant will be assessed a late charge of $50. Landlord reserves and in no way waives the right to insist on payment of the rent in full on the date it is due. Tenant Examination and Acceptance of Premises: The Tenant acknowledges that he has examined the leased premises and his acceptance of this agreement is conclusive evidence that said premises are in good and satisfactory order and repair unless otherwise specified herein; and the Tenant agrees that no representations as to the condition of the premises have been made and that no agreement has been made to redecorate, repair or improve the premises unless hereinafter set forth specifically in writing. The Landlord will deliver the leased premises and all common areas in a habitable condition, pursuant to applicable State law. Tenant takes premises in its AS-IS condition. Occupancy and Use: The premises are to be used only as a private residence for Tenant(s). The premises shall be occupied by no more than Two (2) persons, including children. The premises shall not be used for any purpose other than a private residence without the prior written consent of the Landlord. Security Deposit: Upon execution of this lease, Tenant will deposit with Landlord the sum of Five Hundred Dollars ($500), which is to be held as collateral security and applied on any rent or any other charge that may remain due and owing at the expiration of this agreement, any extension thereof or holding over period or applied on any damages to the premises caused by the Tenant, his family, invitees, employees, trades people or pets, or other expenses suffered by Landlord as a result of a breach of any covenant of the Lease.
