HomeMy WebLinkAbout02-2551STIPULATION AGAINST LIENS THIS AGREEMENT made the of by and between Country Side Village Homes, , 2002, Maryann Wheeler, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in 1104 Oyster Mill Road, Camp Hill, East Pennsboro Township, Cumberland County, Pennsylvania NOW THEREFORE, THIS AGREEMENT WITN~SSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Country Side Village Homes in hand paid by Owner, the receipt whereof is hereby acknowledged, an~ the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic,s liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Signed, Sealed and Delivered (Seal) (Seal) EXHIBIT ~ ALL TF~AT CERTAIN parcel or tract of land situate in East Pennsboro Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at the corner of lands now or late of Fulton Wolfley and the Western side of a twenty (20) feet wide right-of-way; thence along the line of the said Wolfley land in a Southwesterly direction, one hundred forty (140) feet to a point marked by an iron pin at the fence line of the Estate of Jacob Kohler, deceased; thence along the line of land of the Kohler Estate in a Southeasterly direction, one hundred eight (108) feet to a point marked by an iron pin at the Northwest side of a private road; thence along the West side of the said private road in a Northeasterly direction, one hundred thirty-nine (139) feet to a point at the corner of a stone wall and the corner of the said private road and said twenty (20) feet wide right-of-way; thence along the Western side of the twenty (20) feet wide right-of~way in a Northwesterly direction, one hundred thirteen feet, six inches (113.06) to a point and the place of BEGINNING. THE PRIVATE ROAD HEREIN mentioned on the South side of the herein-described lot shall be used by any person whose land or premises adjoin the said private road, their relatives, friends and/or business associates. Said private road shall be maintained by persons whose lands shall adjoin the said private road. SUBJECT to reservations and restrictions of record. BEING TRACT NO. THREE OF THE SAME PREMISES which Cynthia C. Jones and Daniel M. Jones and Country Side Village Homes, by their deed to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Maryann Wheeler.
