Pa.RC.P. 1018.1 requires that every Complaint shall begin with a Notice to Defend substantially in the form set forth in the Rule 1018.1(b). 5. Plaintiffs Complaint does not begin with a Notice to Defend in accordance with Rule 1018.1. WHEREFORE, the Defendant respectfully requests that Plaintiffs Complaint be stricken. PRELIMINARY OBJECTION RAISING FAILURE TO CONFORM TO PA.R.C.P. 1019 6. Pa.R.C.P. 1019(a) requires that all material facts on which a cause of action is based be stated in concise summary form. 7. Plaintiffs Complaint does not plead facts as required but to the contrary pleads conclusions with no factual support whatever. 8. Pa. R.C.P 1019(h) required that when any claim is based upon an agreement the pleading shall state whether the agreement is oral or written. 9. Plaintiffs Complaint does not state whether or not the damages alleged were based on a contract oral or written. 10. If based upon a written contract, the Complaint fails to attach a copy of said writing as required Pa.R.C.P. 1019(i). Pa.R.C.P. 1022 requires that every pleading be divided into paragraphs numbered consecutively and that each paragraph contain only one material allegation. 12. Plaintiffs Complaint, in violation ofPa.R.C.P. 1022 fails to divide the Complaint into paragraphs and to number the same as required by the rule. Plaintiff s Complaint does not plead specific material facts sufficient to allow Defendant to answer or prepare a defense, in that the general subject matter ofthe alleged oral contract is not identified, the material facts supporting the alleged breach of the alleged contract are not set forth nor are material facts set forth to substantiate the damages claimed.
