Plaintiff is Ettline Foods Corporation (Ettline), a Pennsylvania corporation with its principal place of business located at 525 State Street, York, PA 17403. 2. Defendant is Ciro Esposito t/d/b/a as Peppino's Italian Restaurant, a restaurant business located and operating at 3649 Market Street, Camp Hill, PA 17011. 3. Ettline is in the business of selling at wholesale foods and food products to restaurants, food markets and other like entities. 4. On August 19, 2003 the parties entered into a written Agreement, a copy of which is attached hereto as Exhibit "A", by the terms of which Ettline agreed to sell to Defendant goods and services (i.e., food products) and Defendant agreed to pay therefor, either in full upon delivery, or pursuant to credit terms as implemented by Ettline pursuant to the Agreement. 5. Pursuant to the foregoing Agreement, Ettline supplied food product to Defendant from and after August 19, 2003, but has failed to pay for invoices subsequent to January 2006, which invoices included credit delinquency charges as shown on Exhibit "B", attached hereto. 6. Pursuant to the terms of the aforesaid Agreement, Defendant agreed to pay certain finance charges and attorney fees, the finance charges which to date amount to $620.65 (and are continuing). WHEREFORE, Ettline demands judgment against Defendant for the sum of $5,314.45, plus $350.00 for attorney fees, totaling $5,664.45, plus whatever additional finance charges and/or attorney fees that hereafter accrue. All amounts due for goods and services purchased from Seller are payable at the Seltcr's distribution facility from which the goods and services arc delivered. Purchaser shall pay Seller a service charge in an amount equal to either $25.00 or the amount posted by Seller for all checks returned by Purchaser's bank provided, however, that such service charge shall not be due and payable in the event such payment would result in the violation of the usury laws of the applicable jurisdiction. 4. In the event the account is turned over to an attorney or other agency for collection, or suit is brought on same, or the same is collected through any judicial proceeding whatsoever, Purchaser shalt pay all reasonable attorneys' fees and court costs incurred by Seller. 5. In the event any lawsuit is instituted to recover any amounts owed to or property of Seller, the parties agree that venue of any such cause of action shall be in the Court of Common Pleas of York County, PA at York, Pennsylvania, such county being deemed to be the county in which the contract between the parties was made. 6. PurchUcr shall notify Seller by certified mail of any change of ownership of Purchaser.
