COMPLAINT
AND NOW, comes Plaintiff, Linh Chau, by and through her
attorneys, Purcell, Krug and Haller, and files the following
Complaint in Divorce:
1. Plaintiff is Linh Chau, an adult individual with a
current address at 60 Miller Street, Apartment B6, Lemoyne,
Cumberland County, Pennsylvania.
2. Defendant is Jens Rudolf Broecking, an address at 52
Pestalozzi Str, 10627 Berlin, Germany.
3. The Plaintiff has been bona fide residents of the
Commonwealth of Pennsylvania for at least six months immediately
previous to the filing of this Complaint. Defendant is a citizen
of Germany.
4. The Plaintiff and Defendant were married on January 8,
2000 in Philadelphia, Pennsylvania.
5. There have been no prior actions of divorce or for
annulment between the parties.
6. The marriage is irretrievably broken.
VERIFICATION
I, LINH CHAU, Plaintiff in the within action, hereby verify
that the facts contained in the foregoing COMPLAINT are true and
correct to the best of my knowledge, information and belief. I

The National Visa Center (NVC) has your name in its records as the agent of
JENS RUDOLF BROECKING, an applicant for an immigrant visa.

Battered Spouse). In most employment-based immigrant visa cases, the 1-864 need not be filed,
unless a relative of the beneficiary filed the immigrant visa petition or has at least a five percent
ownership interest in the business or corporate entity that filed the petition. We have already sent
the petitioner a letter with instructions about the 1-864 form, if it is required. Further information
on the 1-864 requirements can be found at http://travel.state.gov/aos.html. The petitioner must
determine prior to the visa interview if this provision applies to the applicant's case. The visa
will have to be denied ifa required 1-864 is missing at the time of the visa interview.
If an 1-864 is required, the form and its instructions can be downloaded from our Website at
http://travel.state.gov/aos.html. If required, the applicant must personally submit the
completed 1-864 and all of the required supporting documents to the, consular officer at the time
of the interview.
For each applicant, you must send a completed Application for Immigrant Visa and Alien
Registration (DS-230) Part 1, the signed and completed Instructions for Immigrant Visa
Applicants, to the consular office at the address listed below.
The 1-864, if required, and its supporting documents MUST be presented to the consular
employees on the day of the time of interview. No 1-864 forms or supporting documents should
be sent to the consular office prior to the visa interview, unless specifically required by that
office.

THE MASTER: Today is October 16, 2003.
This is the date set for a Master's hearing in the above
captioned divorce proceedings.
Present in the hearing room are the
Plaintiff, Linh Chau, and her counsel Nichole M. Staley
O'Gorman. Also present is a friend of the Plaintiff, Wanda
Metzger.
The Defendant, Jens Rudolf Broecking, is not
present but coramunicated to attorney O'Gorman that he wished
to have this case continued and have marriage counseling.
According to the Master's understanding, this communication
was made on October 14, 2003. Attorney O'Gorman is going to
state on the record her response to that communication from
the Defendant; the Defendant did not contact the Master's
office either by fax, mail or by telephone. Ail
communication, therefore, was through Plaintiff's attorney.
Upon being advised by Plaintiff's attorney that husband
wished to have the matter continued and have marriage
counseling, the Master communicated to Ms. O'Gorman that he
would not grant a continuance and would not delay the matter
for marriage counseling. Ms. O'Gorman communicated to the
Defendant and she can explain her method of contact with him
regarding the Master's statement about a continuance and
counseling.
This action was commenced by the filing of a

complaint in divorce on May 30,
divorce of irretrievable breakdown
economic claims were raised in the
2002, raising grounds for

complaint nor were any
economic claims raised otherwise in the case by petition,
counterclaim, or amended complaint.
The Plaintiff also filed a petition on
February 20, 2003, raising additional grounds for divorce of
willful and malicious desertion and indignities. However,
we are going to proceed on the basis ,Df an affidavit that
was filed by the Plaintiff averring a separation in excess
of two years. The affidavit of the Plaintiff avers that the
parties separated on January 9, 2000. This affidavit was
filed on January 15,

is incorrect inasmuch as it is not 2002 but instead 2001.

that the Defendant knew of the today's hearing was his
communication with wife's counsel requesting a continuance.
The Defendant previously filed a
counter-affidavit in response to Plaintiff's affidavit under
330t(d). The counter-affidavit was filed on February 3,
2003. In the counter-affidavit husband indicated that he
opposed the divorce because the parties had not lived
separate and apart for a period of two years and that the
marriage is not irretrievably broken.
The complaint in divorce was served
personally on the Defendant in Germany. The date of service
was December 10, 2002. The affidavit of service was filed
with our Prothonotary on December 18, 2002.
Attorney O'Gorman, would you please go on the
record and supplement or comment with regard to the matters
that I have addressed in my opening remarks; may be to
clarify or add to what I have already said about the
evidence that is going to be presented and service of the
documents and communication to you by the Defendant.

October 14, 2003, from the Defendant

14, 2003, I e-mailed a letter to the Defendant indicating
the substance of my conversation with the Master. That
e-mail was sent to Jensrb@aol.com. I have not received any
return e-mail and I have also not received any message
indicating that the e-mail was undeliverable. In fact,
that's the last known e-mail address that my client has.
With respect to the evidence that we intend
to present, I believe the Master summed it up but we are
prepared to present today a copy of a passport as an exhibit
in the case to evidence the last date that my client
traveled to Germany. It is my client's position that the
parties never lived together; however, for purposes of this
hearing she is prepared to accept an October 8, 2001, date
of separation inasmuch as it is at least two years prior to
nOW.

Prior to that I couldn't contact him for some reason. We
have no contact. I couldn't find him. I was half concerned
about him and, you know, at that time we had that 9/11
tragedy and I was really worried about everything. Then a
week later he just show up.
Q How long before that were you unable to
locate your husband?
A At least a month.
Q Did he ever tell you why?
A No; he just give me some kind of excuse,
saying he was busy and at one time he also mentioned that he
was sick, which was not true when I found out later on. I
find out from his family the whole thing was not -- well I
still don't know what, you know, he lie about so many things
so I am not sure what his excuse was.

A Well, I have problem locating him and getting
in touch with him so I finally had to confront -- talk to
his family member, one of his family member. Not everyone
can speak English over there, only another person can speak
English, so I confronted her and I told her that I should

know where he is because he is my husband and that's when I
find out that nobody know that we were married. The whole
family, nobody know, and she also asked his mom and
confirmed whether she know or not and she didn't know
either. I have the e-mail proving that.
Q So finding out that your husband did not
inform his family that he had married you, was that what
prompted you to finally decide that this marriage was over?
A Not just that. I also find out that he had
been lying to me about everything, thLngs that I never
thought he would have a reason to lie about. That's when I
started to feel -- not sure about everything anymore. I
just couldn't trust him anymore. You know I took a chance
on him and now I know that everything was just a lie, I
mean, without any trust, I can't go on anymore.
Q Okay. In your husband's counter-affidavit
that he filed with the Court, he alleged that the last time
you visited him in Germany was December of 2002; is that
correct?
A No.

RECO~.~NDATION
The Master finds that the marriage between
the parties, which occurred on January 8, 2000, is
irretrievably broken.
The Master, based on the testimony and the
exhibit placed on the record, finds that the parties last
saw each other on October 8, 2001, which is the date the
Master finds as the date of final separation.
Consequently, the parties have been se?arated for a period
in excess of two years and the Master recommends a divorce
be granted to the Plaintiff on her complaint averring that
the marriage is irretrievably broken based on the two-year
separation under Section 3301(d) of the Domestic Relations
Code.
A copy of the transcrip-5 and Master's
comments will be sent to the Defendant with the proper
notice advising him of the filing of the record and
recommendations and the right to take exceptions thereto.

My wife's additional claims are not understandable nor ecceptable for me:

I didn't commit "willful and malicious desertation" at all.
I always wanted to communicate and talk to my wife to solve our "problems" peacefully.
It is her who stop communication after she told me not to come to her and who changed the
lock of our apartment so that I can't come home to her ._a~_,~yway. That's why I d,on't cohabit
with her right now. That is the simple cause even ifI don t understand my wife s behavior.

I offered no indignities to my wife at all.
I love her still and I don't wish anything more than to live with her, so why should I talk bad
to her ?
For me this is only another assertion to give me a bad reputation and to conceal her true
reasons for her wish to be divorced from her husband.
I think it is time for her to say the true reasons of her (i.e. another man ?) and to admit that
she alone wants our divorce even if it means she is guilty in this case.
I think it obvious that the situation is like this because I want to say clear that I LOVE MY
WIFE AND I DON'T WANT THIS DIVORCE AT ALL.
If possible I would apply to the court that it sentence us to visit a counsellor and to try it again
first before we decide about a divorce.
If this is not possible my wife should admit her guilt in this and that she is the one who
want the divorce. At least this would be honest, case

Because I can't get an exemption from work for the
16th oh October 2003 it is impossible for
me to appear before the Divorce Master on that day.
I get vacation days for this time and I am not in the economica/situation to lose my job. I
don't think my wife is willingto support me here too.
But I understand the necessity ora hearing in this matter.
Please set another date for the hearing later next year so that I have a chance to apply for
vacation on time.
The deadline for the vacafion_ap4vlication at my working place is the end of February 2004.
