IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. 06-6370 CIVIL TERM CIVIL ACTION - LAW DRIVEKORE, INC., Plaintiff DANIEL MESCALL Defendant COMPLAINT AND NOW, comes the Plaintiff, DriveKore, Inc., by and through its' attorney Charles Rector, Esquire, and avers in support of its' Complaint against Defendant, Daniel Mescall, as follows: 1. Plaintiff, DriveKore, Inc., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, with a principal place of business located at 101 Wesley Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Defendant is an adult individual who resides at 166 Old York Road, Dillsburg, York County, Pennsylvania, 17019. 3. On or about October 10, 2005, Defendant rented a Bobcat Loader with a Backhoe attachment from Plaintiff (see Rental Reservation Contract signed by Defendant attached hereto, incorporate herein and marked as Exhibit "A"). 4. The total rental fee charged to Defendant by Plaintiff is $969.26, (see Invoice #E23135 attached hereto, incorporated herein and marked as Exhibit "B"). 5. Pursuant to the terms of the Rental Contract and invoice, eighteen (18%) percent annual interest is to be charged to all invoices not paid within thirty (30) days of the date of the invoice (see Exhibits "A" and "B" referenced above). 6. Although partial payments were made by Defendant on January 16, 2006, in the amount of $169.26, and on February 2,2006, in the amount of $300.00, Defendant has failed, and or refused, to pay the remaining balance of $574.96 (see Statement dated July 20, 2006, attached hereto, incorporated herein and marked as Exhibit "C"). 7. Additional interest will accrue and be due and owing through disposition of this case. 8. Pursuant to the terms of the Rental Contract, Plaintiff is entitled to and Defendant has agreed to pay "all reasonable collection, attorney, and court fees and other expenses involved in the collection of the charges" (see Paragraph 12 of Exhibit "A" referenced above). 9. Plaintiff has retained the services of the Law Offices of Charles Rector, Esquire, P.C. and has agreed to pay them a fee, which fees accrue monthly and will be calculated upon disposition of the case. 10. Plaintiff has incurred and may continue to incur costs of collection of the balance due from Defendant, which total will be calculated upon disposition of the case. PROHIBITED USES. Use of equipment in the following circumstances is lrohibited and constillltes a beach of contract: (a) Use for illegal purpose or in .lIegal manner. (b) Improper, unintended use or misuse. (c) Use by anyone other han the Lessee or his employees, without the Lessor's written pennission. For damage waiver charge, provided the Lessee takes easonable precautions to protect equipment. die Lessor assumes risk of :amage to equipment. except the following risks assumed by the Lessee: (a) .oss by damage, vandalism. malicious mischief. and theft. (b) Loss, damage, or theft of accessory equipment, such as electric cords, hoses, points, chisels. Ooor polisher brushes, vacuum cleaner tools, elC. The Lessee is obligated to reimburse the Lessor for these items. (c) Loss or damage resulting from overloading, exceeding n.led capacity. misuse, abuse, or improper services of equipment. (d) Damage to tires and tubes caused by blowout, bruises, cuts. or other causes inherent in the use of equipment. (e) Loss due to mysterious disappearance or wrongful conversion by a person entrusted with equipment. (f) Damage waiver is null and void if damage is caused by third party not associated or related to Lessee. In this instance, the Lessor reserves the right to collect from person or company causing damage. THE LESSEE UNDERSTANDS THAT THE DAMAGE WAIVER ~ NOT INSURANCE. THE LESSEE IS OBLIGATED TO SUBMIT TO THE LESSOR A POLICE REPORT ON ALL LOSSESS COVERED UNDER DAMAGE WAIVER PLAN. The Lessee may decline Damage Waiver charge by furnishing the Lessor an acceptable Certificate of Insurance, making cash deposit equal to full value of equipment, or by signing a written agreement, and, in such event, the Lessee shall be responsible for all loss of damage to equipment. 11. THEFI' OF EQUIPMENT. The Lessee agrees to pay for equipment, (at Its replacement cost when rented), for all types of theft or mySll:rious disappearance. Damage Waiver docs not cover theft. 12. COLLECTION COSTS. The Lessee agrees to pay all reasonable collection. attorney, and coun fees and other expenses involved In the collection of the charges or enforcement of the Lessor's rights under this contract. 13. PREPOSSESSION. Upon a failure to pay rent or other breach of this contract. the Lessor may terminate this contract and take possession of and remove equipment from wherever it is. and die Lessor and his agents shall not be liable for any claims for damage or trespass arising out of the removal of the equipment. 14. DISCLAIMER OF MANUFACTURE. The Lessee agrees that the Lessor is neither the manufacturer of the equipment nor the agent of the manufacturer, IS. LOADING AND UNLOADING EQUIPMENT. If die Lessor's employees assist in loading or unloading the equipment. the Lessee agrees to assume the risk of, and hold the Lessor harmless for, any property damage or personal injuries, including damage or injuries attributable to the negligence of the Lessor and its employees. 16. THEFI'. The Lessor of its own discretion may repon as stolen all personal property not returned within the date listed in the "Date and Time Due In" section of the contract or if conditions and circumstances indicate theft before that time. 17. INSPECTION OF TRAILER HITCH. The Lessee agrees to inspect the trailer coupling mechanism and safety chain before leaving the Lessor's premises. The Lessee also agrees to inspect the equipment periodically (every 100 miles) and to maintain the coupling and chain in a safe and secure condition. 18. WAIVER OF CLAIMS. The Lessee waives all claims for personal injury. property damage to the transported equipment. loss of time or inconvenience arising out of the use of a traller. or any accident or breakdown. 19. DAMAGE TO BUMPERS. The Lessor is not liable for damage to the Lessee's bumper or automobile done by detachable hitches. 10. ACCIDENT NOTIFICATION. The Lessee will immediately notify the Lessor in the event of any accident. 11. UNPAID INVOICES. The Lessor. at its own discretion, may reven all chuges to a daily rate if monthly statements or invoices ue not paid on due dates. 22. OVERDUE ACCOUNTS.
