OCo - G 3 ~J tfA L-D STIPULATION AGAINST LIENS WHEREAS, Wheatland Custom Homes, Inc., a Pennsylvania Corporation, of Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland Custom Homes, Inc., a Pennsylvania Corporation of Lancaster County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THA T CERTAIN tract or parcel ofland situate in East Pennsboro Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the southern right-of-way line of Redwood Drive (a fifty foot right-of-way), said point being located the following three (3) courses from the terminus of a curve connecting said right-of-way with the eastern right-of-way line of Larch Lane (a fifty foot right-of-way) 1) North fifty-seven degrees, twelve minutes, forty-eight seconds East, a distance of seventy-five (75.00) feet to a point; 2) by a curve to the right having a radius of one hundred ninety feet (190.00), an arc distance of one hundred eighty-one and eighteen hundredths feet (181.18) to a point; 3) by a curve to the left having a radius of three hundred fifty feet (350.00) an arc distance of fifty-nine and seventy-three hundredths feet (59.73) to a point; thence from said,point of beginning by said southern right-of-way line of Redwood Drive, by a curve to the left, having a radius of three hundred fifty feet (350.00), an arc distance of eighty-eight and seven hundredths feet (88.07) to a point; thence by Lot No.1 06, South nine degrees, forty-five minutes, fifteen seconds East a distance of one hundred twenty-two and ninety-two hundredth feet to a point; thence by Lot No. 111 and Lot ' No. 112 South eighty degrees, fourteen minutes forty-five seconds West, a distance of eighty-five feet (85.00) to a point; thence by Lot No.1 04, North nine degrees forty-five minutes, fifteen seconds West, a distance of one hundred forty-five and eight hundredths feet (145.08) to a point, the place of BEGINNING. BEING Lot No. 105 as shown on the Final Subdivision Plan of Penn Valley, Phase V. Recorded in Plan Book 89, Page 123. UNDER AND SUBJECT, nevertheless, to easements, restrictions, reservations, conditions, and rights of way of record or visible upon inspection of premises. .. 3 err NOW, the . t day of October, 2006, atthe time of and immediately before the execution of the principal contract, and before any authority has been given by the said Wheatland Custom Homes, Inc., a Pennsylvania Corporation to the said Wheatland Custom Homes, Inc., a Pennsylvania Corporation to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Wheatland Custom Homes, Inc., a Pennsylvania Corporation and the further consideration of One Dollar, to Wheatland Custom Homes, Inc., a Pennsylvania Corporation paid by Wheatland Custom Homes, Inc., a Pennsylvania Corporation it is agreed that no lien shall be filed against the building by the contractor, or any sub- contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. WITNESS, our hand and seals the day and year aforesaid.
