WHEREAS, Daniel J. Yurovich of 1278 Summit Way, Mechanicsburg, PA 17050, is about to
execute contemporaneously herewith, a contract, with Carlson Construction Inc. of 1208
Summit Way, Mechanicsburg, PA, for the erection of a building upon premises commonly
known as 1278 Summij Way, Township Hampden, Cumberland County, Pennsylvania, as
set forth in the deed dated 07/09/03, recorded at Deed Book 258, Page 224 (part of), in the
Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in
Exhibit "A" which is incorporated herein and attached hereto.
NOW, October 31, 2006, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the ~aid Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract wijh Contractor and the further consideration of One
Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any sUbcontractor,nor by any of the materialmen or workmen
or any other person for any labor, or materials pL/rchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.

Exhibit "A"
ALL THA T CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the northern right-of-way line of Summit Way, said point being the
southeastern corner of Lot #40, as shown on the "Final Subdivision Plan for Hampden Summit - Phase
2"; thence, along the said right-of-way line South 74 degrees 42 minutes 11 seconds West a distance of
6.90 feet to a point; thence, along said right-of-way on a curve to the right having a radius of200.00 feet,
an arc length of 197.71 feet and a chord bearing of North 76 degrees.58 minutes 39 seconds West a
distance of 189.76 feet to a point; thence, North 55 degrees 09 minutes 32 seconds East a distance of
164.92 feet to a point; thence, South 59 degrees 59 minutes 55 seconds East a distance of26.33 feet to
a point; thence, South 15 degrees 17 minutes 49 seconds East a distance of 126.47 feet to a point, the
place of BEGINNING.
BEING Lot #40 Plan of Hampden Summit, Phase 2, recorded in Plan Book 89, Page 83
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances and
other matters of record or that which a physical inspection or survey of the premises would reveal.
