PETITION TO PROBATE CODICILS
Petitioners are two of the four Co-Executors appointed for the above referenced
estate on September 15,2006 when the decedent's will dated March 30,1992 was
admitted to probate. They represent the following in support of this petition to probate
three Codicils to the Will that has already been probated:
1. Following the probate of the decedent's Will and their appointment as co-
executors, an inventory of the decedents safe deposit box at M&T Bank was
completed on October 12,2006.
2. During the inventory of the safe deposit box three documents were found that
were written in the hand of the decedent and each was titled as a codicil. The
Petitioners believe each is a codicil to the Will dated March 30, 1992 and that
each should be probated. The codicils are attached to this petition as
3. One codicil was dated January 16, 1994, was signed at the end by Hilda Dysert
and witnessed by Zelda Barnes. The persons benefiting from the language in this
codicil are as follows:
a. Martha E. Landis, a petitioner herein, and a co-executor [a ring]
b. Janice Hippensteel, a petitioner herein, and a co-executor [a diamond]
c. Ann Parker, now Ann Mountz, a co-executor [a diamond]
d. First United Church [$5,000.00] [This is the First United Church of Christ, 30
N. Pitt St., Carlisle, P A 17013 where decedent's husband sang in the choir]
e. Zelda Barnes, subscribing witness to the codicil who resides at 54 E. Louther
St., Carlisle, PA 17013 [$1,500]
f. Ronald & Susan Shughart [repayment excused]. Ronald Shurghart is one of
the co-executors and resides at 1875 Resevoir Dr., Carlisle, P A 17015 and
Susan Shughart resides at 44 E. North St., Carlisle, P A 17013.
4. Another codicil was dated January 1, 1998, was signed at the end by Hilda S.
Dysert and was witnessed by Zelda Barnes. It excuses any repayment of
decedent's financial assistance to Adam C. Shughart. There is no known
obligation due to the decedent's estate from Adam C. Shughart so this codicil has
no affect on the estate administration unless such an obligation were to be
asserted.
5. The third codicil was undated but kept in the same envelope as the other two. It
was signed at the end by Aunt Hilda, and it was witnessed by Zelda Barnes. It
contains no expressions of intent or directions affecting the decedent's estate.
6. Two non-subscribing witnesses attest to the fact that each of the three writings
were signed by the decedent, Hilda S. Dysert. The oath of the non-subscribing
witnesses is filed herewith.
7. The codicils make no change in the designation of executors for the estate.
8. A list of the heirs ofthe decedent's estate with each individual's address and the
nature of the interest in the estate is attached hereto as Exhibit 1. Since there is
sufficient value in the estate to provide for all specific and cash bequests, the only
heirs affected by the codicils are the 16 individuals listed as residuary heirs under
Item VII of the will.
WHEREFORE, Petitioners respectfully request the probate of the three codicils
referenced herein. ~
