Diehl, makes the following Complaint in Divorce, and, in support thereof, avers as follows: I. The Plaintiff, Fawn Van Vorce, is an adult individual who currently resides at 1111 Yverdon Drive, Apartment A-3, Camp Hill, Cumberland County, Pennsylvania 170 II. 2. The Defendant, Guy Van Force, II, is an adult individual who currently resides at 46 Epps Street, Ft. Rucker, Alabama 36362. 3. The Plaintiff has been a bona fide resident of the Commonwealth of Pennsylvania for at least six months immediately prior to the filing of this Complaint. 4. The Plaintiff and the Defendant were married on August 17, 1991 in Lemoyne, Cumberland County, Pennsylvania. 5. There have been no prior actions of divorce or for annulment between the parties. 6. The Defendant is an active-duty member of the United States Anny stationed at Fort Rucker, Alabama; Defendant is not currently deployed. 7. The Plaintiff has been advised of the availability of counseling and the right to request that the Court require the parties to participate in counseling. Knowing this, Plaintiff does not desire that the Court require the parties to participate in counseling. 8. Plaintiff and Defendant are citizens of the United States of America. 9. The parties' marriage is irretrievably broken. WHEREFORE, the Plaintiff, Fawn Van Vorce, respectfully requests your Honorable Court to enter a decree in divorce pursuant to 23 P.S. Diehl, Esquire, hereby respectfully petitions this Honorable Court for Leave to Withdraw as Counsel for the Plaintiff, Fawn Van Vorce, and in support thereof, avers as follows: 1. Petitioner is Thomas S. Diehl, Esquire. 2. Respondent is Fawn Van Vorce. 3. Petitioner was retained by the Respondent in 2002 to represent her at pursuant to an action in divorce. 4. The Petitioner filed a divorce action on behalf of the Respondent docketed at the above caption. 5. Approximately ninety days following the service of the Divorce Complaint upon Respondent's husband, he was provided a Consent and Waiver necessary to finalize the divorce action. 6. At that time, Respondent's husband was not represented by counsel. 7. As Respondent's husband would not sign and return the Consent and Waiver, it was determined that it would be necessary to pursue a two-year separation divorce proceeding under Section 3301(d) ofthe Family Code. ~. 8. On or about the autumn months of 2003 the Petitioner lost contact with the Respondent. Petitioner then believed that the Respondent moved without leaving a forwarding address. 9. Petitioner attempted to contact Respondent through telephone calls and letters written to her last know address, but was unsuccessful. 10. In December of 2003, Petitioner closed his private law practice and began working for the Commonwealth of Pennsylvania. 11. In the months leading up to December of 2003, Petitioner referred his active cases to other counsel. 12. Respondent's case was not referred to other counsel, as Petitioner had no means of contacting Respondent in order to transfer her case. 13 On or about June of 2005, Petitioner received a letter from Taylor P. Andrews, Esq., giving notice that he would be representing husband and expressed husband's desire to finalize the divorce. 14 Petitioner again attempted to contact Respondent, this time through an address and telephone number provided by husband's counsel. A copy of said letter is attached as "Exhibit A", 15. Respondent did not respond to Petitioners letter or telephone messages. 16. Petitioner desires to be removed as counsel in order to permit husband's counsel to directly contact the Respondent. 17. Respondent's retainer has been exhausted pnor to December of 2003 and continued representation would cause an undue financial burden upon the Petitioner. 18. On October 14,2005, Husband's counsel, Taylor P. Andrews, Esq., was contacted by telephone regarding this request to withdraw and does not oppose Petitioner's withdraw on the condition that he is provided an accurate address for the Respondent for future service. WHEREFORE, the Petitioner, Thomas S.
