lambert Custom Homes, Inc.
hereinafter referred to as Contractor,

Jason G. Myers and Nicole B. Myers
hereinafter referred to as Owner,
Whereby the former undertook and agn!ed to erect and construct a single family dwelling on that certain
lot of ground situate in South Middleton Township, Cumberland County, Pennsylvania. Address known
as 59 Old Town Road Gardners, PA 17325, At; set forth in a Plan prepared by LaRue Survey Assoc.
Recorded in Plan Book 91, Page 135

NOW THEREFORE, THlS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum. of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and an parties acting through or under the~ covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done Of materials
fUl1lished by them or any of them under said. contract or otherwise, for, towards, in, or about the erection
and construction 01 the said buildings on the lot above-described, and the said Contractor, for
themselves, their subcontractors and others under them, hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and
agree that this instrument. waiving the right of lien, shall be an independent covenant.

Patrick R. Orlousky; thence along lands of Patrick R. Orlousky, South 25 degrees 39
minutes 14 seconds East, a distance of 2194.36 feet to a point; thence along lands now or
formerly of Robert L. Smith, South 68 degrees 17 minutes 11 seconds West, a distance of
225.99 feet to a point; thence along lands now or formerly of Jack R. Group, North 08
degrees 58 minutes 53 seconds West, a distance of 651.04 feet to a planted stone; thence still
