COMPLAINT
AND NOW, come the Plaintiffs, Carmine A. Natale, Jr. and Cindy A. Natale by and
through their attorneys, Bruce D. Foreman, Esquire and Foreman & Foreman, P.C., and file the
instant Complaint, and in support thereof, aver as follows:
1. Plaintiffs, Carmine A. Natale, Jr. and Cindy A. Natale, are adult individuals and
husband and wife, residing at P.O. Box 61095, Harrisburg, Pennsylvania 17106-1095.
2. Defendants, Merle D. Dimeler and Evelyn M. Dimeler, are adult individuals and
husband and wife, residing at 354 Mallard Lake, Selbyville, Delaware 19975.
3. At all times relevant hereto Defendant Merle D. Dimeler and Defendant Evelyn
M. Dimeler acted as each other's agents and all acts of either are the acts of both.
4. On or about the 17th day of December, 2004, Defendants, joint owners of the
premises at 35 East Willow Terrace Drive, Mechanicsburg, Pennsylvania 17050 ("Premises"),
entered into a written contact to sell the Premises to Plaintiffs. (A true and correct of the said
written contract is attached hereto, labeled Exhibit "A" and made a part hereof.)
5. As part of the sale transaction of aforesaid, and in purported compliance with the
Real Estate Seller Disclosure Law, 68 Pa. C.S.A. Section 7301 et. seq., Defendants gave a written
disclosure purporting to disclose the condition of Premises and any material defects of the
Premises being sold. (A true and correct copy of the said Seller's Property Disclosure Statement
is attached hereto, labeled Exhibit "B" and made a part hereof.)
6. The said written Seller's Property Disclosure Statement delivered by Defendants
to Plaintiffs indicates, in paragraph 9, that the Premises was served by an individual on-lot

sewage disposal system and drain field and that the Defendants were not aware of any past or
present leaks, back-ups or problems relating to the sewage system.
7. Plaintiffs believe and therefore aver, that Defendants had knowledge that the
aforesaid information in the Seller's property Disclosure Statement was in error, inaccurate and
omitted material information including but not limited to the fact that Defendants frequently
had to pump their on-site sewage system, that Defendants had been advised of the inadequacy
of their on-site sewage system by entities servicing the same and that Defendants lacked the use
of their on-site sewage system due to its deficiencies and inadequacies.
8. As a further "disclosure" to Plaintiffs, Defendants provided a copy of a "report"
from Associated Products Services, Inc. dated August 4, 2004 addressed to Defendant, Merle D.
Dimeler regarding "Septic Cleaning and Inspection of On-Site Sewage System" with regard to
the Premises. (A true and correct copy of the "report" is attached hereto, labeled Exhibit "C" and
made a part hereof.)
9. Plaintiffs believe and therefore aver that the report, aforesaid, is an apparent
attempt to meet the non-liability rule of 68 Pa. C.S.A. 9 7309(a)(3) or 9 7309(c), failed to do so
as Plaintiffs believe the report was not from a person or entity thereon listed or certified.
10. Plaintiffs believe and therefore aver the delivery of the aforesaid report further
demonstrates Defendants intent to defraud and mislead Plaintiffs.
11. Defendants, jointly and severally represented to Plaintiffs that the on-site sewage
system at the Premises was in good operating condition and that no problems were being or had
been experienced with the same at the time of preparing the aforesaid disclosure, when
delivering the disclose and from the date of the contract of sale through settlement.
12. When Defendants represented to Plaintiffs that the on-site sewage system at the
Premises was in good and working order and the no problems had been experienced, the same
was not true in that the on-site sewage system was not in good working condition, was not
properly functioning and required service and Defendants were aware of the same and made
their statements with knowledge of their falsity or with reckless indifference to their truth or
falsity.
13. Plaintiffs believe and therefore aver that Defendants intentionally and knowingly
misrepresented the condition of the on-site sewage system on the Premises to Plaintiffs.
14. As a result of the condition of the on-site sewage system on Premises Plaintiffs
were required to expend $12,199.90 to correct the same to have a minimum properly
functioning on-site sewage system on Premises to service the residence which they purchased
from Defendants. Damages are more specifically enumerated in Exhibit "D," attached hereto
and made a part hereof.
COUNT 1- BREACH OF CONTRACT
15. Plaintiffs incorporate paragraph one through fourteen inclusive, as fully as if set
forth.
16. Defendants breached the expressed terms of their contract that they knew of no
defects or problems in the condition of the on-site sewage system on Premises.
WHEREFORE, Plaintiffs demand judgment against Defendants in the amount of
$12,199.90 together with costs of suit and interest.
COUNT 11- NEGLIGENT MISREPRESENTATION
17. Plaintiffs incorporate paragraph one through sixteen inclusive, as fully as if set
forth.
18. Defendants negligently represented to Plaintiffs that the on-site sewage system at
Premises was in proper working order and that there were no defects to the said on-site sewage
system.
WHEREFORE, Plaintiffs demand judgment against Defendants, jointly and severally
in the amount of $12,199.90 together with costs of suit and interest.
COUNT 111- INTENTIONAL MISREPRESENTATION/FRAUD
19. Plaintiffs incorporate paragraph one through eighteen inclusive, as fully as if set
forth.
20. Defendants knowingly and intentionally misrepresented the condition of the on-
site sewage system at Premises to Plaintiffs.
21. Plaintiffs believe and therefore allege that the conduct of Defendants was
outrageous, fraudulent and shocking to the conscience.
WHEREFORE, Plaintiffs demand judgment against Defendants, jointly and severally
in the amount of $12,199.90 together with punitive damages, costs of suit and interest.
COUNT IV - VIOLATION OF REAL ESTATE SELLER DISCLOSRUE
22. Plaintiffs incorporate paragraph one through twenty-one inclusive, as fully as if
set forth.
23. Defendants violated the Real Estate Seller Disclosure Law.
WHEREFORE, Plaintiffs demand judgment against Defendants, jointly and severally
in the amount of $12,199.90 together with punitive damages, costs of suit and interest.

RE: Septic Clellning and Inspection of on-site Sewage System
To Whom It May Concern:
On 07/01104 and again on 07/30/04 Associated Products Services, Inc., cleaned the
septic tank located at 35 E. Willow Terrace Drive, Mechanicsburg,P A 17055.
Mr. Geoghan of our company removed the septage, and then inspected. the baffles
:ind tanle structure. There was no back flush and ail of the units flowed without
obstruction to the tanlL
As requested, our Company inspected the on Jot wastewater treatment system at the
above address on 07/01104 and 07/30/04. This letter provides you with a report of
the inspection based on the preliminary infonnation you provided and the field
inspection.
On oUr:' first visit the washiug machine, sum.p pump and a sinli. were separately
discharged t6 the stream.. These items were replumbed by arrangements made by
,Mr. Di,meler to the septic tank. Mr. Geoghan returned to reinspect the system after
the changes. Mr. Geoghan found parts of the drain field to be deeper than his probe .
..od. The septic system appears to be in working order.
The future condition of the septic system will depend on the size of the family of thc
prospective buyer, their water usage and tile obse.rvance of a proper maintenance
schedule. Even such factors as the weather can affect the proper function of the
septic system.

25. Defendants resided at 35 East Willow Terrace Drive, Mechanicsburg,
Pennsylvania, 17050, hereinafter "Premises," for over 20 years.
26. During their time of residence at the Premises, Defendants never had any
knowledge of any leaks, back-ups, or other reportable problems relating to the sewer
system.
27. On or about August 4,2004, Paul R. Nelson, President of Associated
Products Services, Inc., did represent to Defendants that:
a. There was no back flush and all units flowed without obstruction to the
tank;
b. That the septic system appeared to be in working order; and
c. That the future condition of the septic system would depend on the size of
the family of prospective buyer, their water usage and the observance of a
proper maintenance schedule.
28. Plaintiffs did move into the Premises with a family.
29. Plaintiffs did not initiate legal proceedings against Defendants until
November 14, 2006.
30. Defendants believe and therefore aver that any and all damage to the
sewer system at the Premises is a result of increased usage over an extended period of
time.
31. Defendants are without the requisite foreknowledge of any disclosable
incident, relating to sewer system, to sustain any of Plaintiffs' Counts.
32. Plaintiffs' Complaint and all claims thereunder are barred by the doctrine
of equitable estoppel.
33. Plaintiffs' Complaint and all claims thereunder are barred by the doctrine
of consent.
34. Plaintiffs' Complaint and all claims thereunder are barred by the doctrine
of laches.
35. Plaintiffs' Complaint and all claims thereunder are barred by the doctrine
of release.
36. Plaintiffs' Complaint and all claims thereunder are barred by the doctrine
of statute of limitations.
37. Plaintiffs' Complaint and all claims thereunder are barred by the doctrine
of truth and waiver.
Wherefore, Defendants, Merle D. Dimeler and Evelyn M. Dimeler, respectfully
request judgment be denied Plaintiffs, Carmine A. Natale, Jr. and Cindy A. Natale, and
that this Honorable Court enter judgment for Defendants and award all costs and fees
associated in defending this action.

AND NOW come the Plaintiffs, Carmine A. Natale, Jr. and Cindy A. Natale
through their attorney Bruce D. Foreman, Esquire and Foreman & Foreman, P.C., and in
response to Defendant's New Matter, reply as follows:
24. Plaintiffs incorporate the averments of Plaintiffs' Complaint, paragraphs I
through 23, inclusive, as fully as if set forth.
25. Denied. After reasonable investigation, Plaintiff lacks information sufficient
to determine the truth or falsity of paragraph 25 of Defendant's New Matter and,
accordingly, the same is denied and, if relevant, strict proof thereof is demanded at trial.

28. Admitted. More specifically Carmine A. Natale, Jr., Cindy A. Natale, Amy
Natale, and their daughter's mother-in-law Ruth Wright moved into the Premises.
29. Denied. To the contrary the complaint was filed on November 6,2006 as
indicated buy the Prothonotary time stamp. In addition Plaintiff contacted Defendant
several months earlier in an attempt to resolve this matter.
30. Denied. After reasonable investigation, Plaintiff lacks information sufficient
to determine the truth or falsity of paragraph 25 of Defendant's New Matter and,
accordingly, the same is denied and, if relevant, strict proof thereof is demanded at trial.
