WHEREAS, ECC, Inc. T/A The Eagi~ Construction Company, with offices at 701 S. Antrim
Way, Greencastle, PA 17225, bereigmt~er called "Comractor", entered into a contract with the
American Legion Post #223, 15 W. King Street, Shippensburg, PA 17257, bereinafler called
"Owner", to provide materials and perform labor necessary to construct their new facility located
on Dykeman Road, Shippensburg, PA 17257 - General Construction in the County of
Cumberland and Commonwealth of Pennsylvania, being the same premises which American
Legion Post #223 by its Deed recorded in the Recorder's Office in and for Cumberland County,
at Shippensburg, Pennsylvania, in Deed Book 226 Vol. 81, Page 86, granted and conveyed unto
the American Legion Post #223 located on Dykeman Road, Shippensburg, PA.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part
of the said Contract and for the consideration therein set forth, that neither the undersigned
Contractor, any Subcontractor or material supplier, nor any other person furnishing labor or
materials to the said Contractor under this Contract shall file a lien, commonly called a
mechanic's lien, for work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary in accordance
with the requirements of Section 1402 of the Mechanics Lien Law of 1963 of the
Commonwealth of Pennsylvania in such case provided.
IN WITNESS WHEREOF, the said parties hereto have set their hands and seals or caused these
presents to be executed by their proper corporate officers, and their respective corporate seals
